A presente monografia aborda o tratamento da sexualidade feminina na sociedade
brasileira, com enfoque nos efeitos de tal tratamento para o sistema judiciário e para
o ordenamento jurídico. A partir de análise histórica dos conceitos atribuídos e
impostos à corpos femininos, demonstrou-se que o sistema jurídico e a legislação são
reflexos da sociedade e, consequentemente, perpetuam ideais conservadores e
nocivos à liberdade feminina, em especial no tocante à sexualidade de mulheres e
meninas. Como complemento destacou-se a dicotomia presente no pensamento
conservador que necessita de mulheres hiperssexualizadas como forma de
manutenção do ideal de recato imposto à figuras femininas. Abordou-se, ainda, os
efeitos negativos da postura inquisitorial de juristas e do judiciário brasileiro diante de
vítimas de crimes de gênero, em desacerto com a legislação contemporânea. Por fim,
relatou-se as semelhanças e diferenças entre dois casos proeminentes de violência
de gênero em épocas e contextos sociais distintos, destacando a o conceito de
vilanização de vítima e resguardo de infratores.
This monograph addresses the treatment of female sexuality in Brazilian society, focusing on the effects of such treatment on the judicial system and the legal system. Based on a historical analysis of the concepts attributed and enforced on female bodies, it was demonstrated that the judicial system and legislation are reflections of society and, therefore, perpetuate conservative and harmful ideals of female freedom, especially regards the sexuality of women and young girls. As a complement, the dichotomy present in conservative thinking that needs hypersexualized women as a way of maintaining the ideal of demure imposed on female figures was highlighted. The project also addressed the negative effects of the inquisitorial posture of Brazilian jurists and of the judiciary system towards victims of gender crimes, in disregard of contemporary legislation. Finally, the similarities and differences between two prominent cases of gender violence in different times and social contexts were reported, highlighting the concept of victim vilification and protection of defaulters.
