Solução consensual pela repactuação de contratos administrativos: limites e possibilidades a partir da jurisprudência sobre a Lei n.13.448/2017

Abstract
Este trabalho olha para uma recente lei do Direito Administrativo – a Lei nº 13.448/17, que trata
sobre a prorrogação e relicitação dos contratos de parceria – e busca compreender de que forma
ela tem sido entendida e aplicada a partir de um olhar jurisprudencial, focando em decisões que
trouxeram novos desdobramentos à legislação citada: a ADI 5.991 do STF, Acórdão 1.593/2023
do TCU e ADI 7.048 do STF. Com isso, a partir de uma análise em busca dos elementos de
decisões utilizados pelos Ministros objetivou-se compreender quais os limites e possibilidades
quando o debate versa sobre a repactuação dos contratos administrativos, seja no âmbito da
prorrogação contratual, seja no âmbito da relicitação. Após análise individual das decisões
constantes nos acórdãos, percebeu-se a existência de quatro grandes pontos de discussão: (i) a
definição de parâmetros nos votos; (ii) a desistência do processo de relicitação como uma
inovação jurisprudencial; (iii) o debate sobre imutabilidade do objeto e mutabilidade das
condições contratuais; e (iv) a importância da demonstração da vantajosidade e o diálogo com
os órgãos técnicos. Com base na discussão instituída, conclui-se que a solução consensual pela
repactuação dos contratos administrativos sob a ótica da jurisprudência sobre a Lei nº
13.448/2017 tem avançado no debate e é elucidativa para compreensão dos limites e
possibilidades de sua aplicação. Embora não seja possível prever o quanto tais decisões irão se
sustentar no decorrer do tempo, é certo que elas contribuem para o avanço na repactuação
contratual e conferem parâmetros para o seu cumprimento.
This final paper looks at a recent Administrative Law act - No. 13.448/17, which deals with the extension and rebidding of partnership contracts - and seeks to understand how it has been understood and applied from a jurisprudential perspective, focusing on decisions that have brought new developments to the legislation: STF ADI 5.991, TCU Decision No. 1.593/2023 and STF ADI 7.048. Based on a jurisprudential analysis in search of the elements of the decisions used by the Courts, the aim was to understand the limits and possibilities when the debate deals with the renegotiation of administrative contracts, whether in the context of contract extension or rebidding. After an individual analysis of the decisions contained in the rulings, four major points of discussion emerged: (i) the definition of parameters in the votes; (ii) the abandonment of the rebidding process as a jurisprudential innovation; (iii) the debate on the immutability of the object and the mutability of the contractual conditions; and (iv) the importance of demonstrating advantage and dialogue with technical bodies. Based on the discussion, it can be concluded that the consensual solution of renegotiating administrative contracts, from the perspective of Law No. 13,448/2017, has advanced the debate and is enlightening for understanding the limits and possibilities of its application. Although it is not possible to predict how much these decisions will be sustained over time, it is certain that they contribute to progress in contract renegotiation and provide parameters for compliance.
