Resumo
O presente trabalho tem por objetivo propor a integração dos animais como sujeitos de direito
no ordenamento jurídico brasileiro, vez que, via de regra, são vítimas de todo tipo de exploração
e discriminação. Para isso, partimos de uma reflexão histórico-cultural a fim de elucidar a lógica
antropocêntrica da humanidade, seguindo para novas correntes filosóficas ambientais em
tempos atuais. Analisaremos pensamentos e teorias de questões éticas e cientificas de grandes
professores como Peter Singer e Tom Regan, quanto à inclusão dos animais na esfera da
considerabilidade moral do ser humano. Serão abordadas questões referentes à senciência dos
animais, assim como do especismo, e o atual tratamento destes no âmbito nacional, a fim de
comprovar a iminente necessidade de alteração do ordenamento jurídico, como vem sendo feito
no âmbito internacional, a partir das teorias da subjetividade jurídica dos animais. Por fim,
analisaremos determinado projeto de lei com o fim a que pretendemos, assim como o progresso
jurisprudencial de Habeas Corpus impetrados em favor de animais, garantindo um
reconhecimento tácito de sua classificação como sujeitos de direito.
This undergraduate paper aims to suggest that animals should be treated as subjects of law in the Brazilian legal system, since, in most cases, they are victims of all types of exploitation and discrimination. For that, we start from a cultural-historical standpoint, questioning humanity’s anthropocentric way of life, moving on to new, environmental philosophical ways of thinking. We analyze theories of ethical and scientific matters from professors such as Peter Singer and Tom Regan, regarding the inclusion of animals in the same moral ground as human beings. We discuss issues regarding speciesism as well as the sentience of animals, and their current treatment within national law, in order to prove the imminent need to change our legal system, as is being done internationally, based on theories of animals legal subjectivity. Finally, we analyze a specific bill relevant to what we intend, as well as the jurisprudential progress of Habeas Corpus in favor of animals, ensuring a tacit recognition of their classification as subjects of law.
