Abstract
O presente artigo tem por intuito a realização de um breve estudo referente as transformações legislativas, econômicas e político brasileiras, destrinchando os aspectos da crise enfrentada nos últimos anos e uma possível forma de proteção dos contratos internacionais.
A cláusula hardship, instrumentos muito presentes nos contratos internacionais, permite a renegociação contratual ante a transformações que ocasionem a impossibilidade de cumprimento do acordado, buscando a manutenção da atividade comercial e, com isso, da economia.
The purpose of this article is to conduct a brief study on the Brazilian legislative, economic and political transformations, disentangling the aspects of the crisis faced in recent years and a possible form of protection of the international contracts. The hardship clause, a common instrument in international contracts, allows the contract renegotiation in the face of transformations that cause the impossibility of compliance with the agreed, seeking the maintenance of the commercial activity and, thus, the economy.
