Smart contracts, termo cunhado por Nick Szabo, são gerados mediante protocolos
computacionais que, de forma autônoma, executam os termos ali estabelecidos. Esta
ferramenta se tornou palpável das mais variadas formas a partir do surgimento da tecnologia
Blockchain, que possibilita que essas transações sejam feitas de forma transparente,
resguardando a autenticidade do compromisso ali firmado. Neste diapasão, o presente
trabalho passou a investigar a compatibilidade do Smart contract junto às normas e princípios
do Direito do Consumidor brasileiro. Para isso, foram analisados o conceito de contrato na
doutrina brasileira, a segurança jurídica que um Smart contract oferece e, por fim, uma
análise pormenorizada sobre sua autoexecutoriedade e os riscos em casos de estarem nele
estabelecidos cláusulas abusivas considerando, também, a hipossuficiência do consumidor.

This tool became palpable in the most varied ways since the beginning of Blockchain technology, which allows these transactions to be carried out transparently, safeguarding the authenticity of the commitment entered into there. In this vein, the present work began to investigate the compatibility of the Smart contract with the norms and principles of Brazilian Consumer Law. For this, was analyzed the concept of contract in Brazilian doctrine, the legal security that a Smart contract offers, and, finally, a detailed analysis of self-execution and the risks in cases of abusive clauses being established on it, also considering the hyposufficiency of the consumer.
