Resumo
Este trabalho de conclusão de curso tem como objetivo apresentar uma análise acerca
da eficácia das medidas socioeducativas previstas no artigo 112 do Estatuto da
Criança e do adolescente, assim como sua aplicação aos adolescentes em situação
de conflito com a lei. Para tanto, inicialmente foi realizada uma pesquisa no tocante
ao surgimento dos direitos da criança e do adolescente, bem como sua evolução no
Brasil e, a partir disso, foi apresentado o modo como a legislação vigente atua para
assegurar esses direitos. Posteriormente, será abordada a definição de adolescência
e a situação de inimputabilidade do adolescente, o conceito e o procedimento de
apuração do ato infracional. Ademais, foram analisadas a aplicação de cada uma das
medidas socioeducativas e, por fim, a eficácia e a ressocialização dos adolescentes
após o cumprimento das medidas.
This final paper aims to present an analysis of the effectiveness of the socio educational measures provided in Article 112 of the Statute of the Child and Adolescent, as well as its applicability to adolescents in conflict with the law. To this end, initially the research was conducted about the advent of the rights of children and adolescents, as well as their evolution in Brazil, and from there, was presented the way in which current legislation acts to ensure these rights. Subsequently, will be addressed the definition of adolescence and the situation of the legal disability of the adolescent, the concept and the procedure counting of the infraction act. Furthermore, the application of each of the socio-educational measures was analyzed and, finally, the efficacy and resocialization of adolescents after they have completed the measures.
