A pesquisa aborda a evolução das políticas públicas voltadas ao setor audiovisual a partir da
Constituição Federal de 1988 que ampliou o conceito dos direitos culturais e deu
responsabilidade ao Estado de proteger e incentivar a cultura brasileira, além de viabilizar seu
acesso. Em seguida, discorrer sobre a construção legislativa com políticas via incentivo fiscal
nos anos 1990, Lei Rouanet e a Lei do Audiovisual, seguida da criação da Agência Nacional
de Cinema que implementou uma nova política nacional, com a introdução da Contribuição
para o Desenvolvimento da Indústria Cinematográfica Nacional e a formação do Fundo
Setorial do Audiovisual. Também destacar a regulamentação da TV Paga que potencializou
toda a cadeia produtiva nacional. Até chegar em maio de 2024, com o surgimento de um novo
modelo de distribuição de conteúdo, o Vídeo Sob Demanda, que alterou significativamente o
modo de consumo e, diferentemente de outros agentes econômicos do setor, seus provedores
não são regulamentados, evidenciando uma lacuna normativa que vem sendo debatida pela
ANCINE e mais recentemente no âmbito legislativo com os Projetos de Lei 2331/2022 e
8.889/2017. O objetivo geral desta pesquisa é ressaltar a necessidade de defesa e
fortalecimento de políticas públicas de regulamentação e fomento, além do respectivo dever
jurídico constitucional que os agentes que atuam no Vídeo sob Demanda devem ter com o
mercado audiovisual nacional. Para isso, é necessário estudar a situação atual e analisar as
diferentes formas de implementá-la a fim de verificar qual resultará em maiores benefícios
com a devida segurança jurídica e regulação adequada, que possa atender aos produtores e
cidadãos.
The research addresses the evolution of audiovisual public policies since the 1988 Federal Constitution, which expanded the concept of cultural rights and gave the State responsibility for protecting and encouraging Brazilian culture and enabling its access. Then, discuss the legislative construction with policies via tax incentives in the 1990s, the Rouanet Law and the Audiovisual Law, followed by the creation of the National Cinema Agency that implemented a new national policy, with the introduction of the Contribution to the Development of Industry National Cinematographic and the formation of the Audiovisual Sector Fund. Also point out the Pay TV regulation that boosted the entire national production chain. Until today, with the emergence of a new content distribution model, Video On Demand, which has revolutionized the mode of consumption and unlike other economic agents in the sector, its providers are not regulated, highlighting a regulatory gap which has been debated by ANCINE and more recently at the legislative level with Bills 2331/2022 and 8,889/2017. The general objective of this research is to demonstrate the need to defend and strengthen public regulatory and development policies, in addition to the respective constitutional legal duty that agents working in Video on Demand must have with the national audiovisual market. To do this, it is necessary to study the current situation and analyze the different ways of implementing it in order to verify which will result in greater benefits with due legal certainty.
