Resumo
O presente artigo discorre sobre as inimputabilidades presentes no Código Penal
brasileiro, sendo elas a inimputabilidade por doenças mentais, desenvolvimento mental
incompleto ou retardado, a menoridade, e alguns casos de embriaguez. Assim, elas serão
estudadas através do instituto da culpabilidade, o qual consiste no juízo de reprovação pessoal
que se realiza sobre a conduta típica e ilícita praticada pelo agente. Nessa diretriz, não deve
ser exigido o mesmo juízo de valor dos indivíduos inimputáveis e dos imputáveis, uma vez
que o doente mental, por exemplo, tem problemas que o impedem de entender o caráter ilícito
do fato e de autodeterminar-se de acordo com ele. Por isso, esses indivíduos não devem ser
imputáveis, o que lhe dão o direito de, ao invés da pena de prisão, cumprir uma medida de
segurança necessária. Assim, a pesquisa demonstrará as espécies de medidas de seguranças e
suas problemáticas, e além disso, abordará também sobre a semi-imputabilidade, a qual
também permite, em alguns casos, que o agente cumpra medida de segurança, ou cumpra pena
reduzida de um a dois terços.
This article talks about the non-imputabilities present in the Brazilian Penal Code, which are non-imputability of mental illnesses, incomplete or delayed mental development, minority, and some cases of drunkenness. Thus, they will be studied through the institute of culpability, which consists of the judgment of personal disapproval that is made regarding the typical and illicit conduct practiced by the agent. In this guideline, the same value judgment should not be required from non-imputable and imputable individuals, since the mentally ill, for example, has problems that prevent them from understanding the illicit nature of the fact and from self-determining themselves in accordance with it. Therefore, these individuals should not be held accountable, which gives them the right, instead of a prison sentence, to comply with a necessary security measure. Thus, the research will demonstrate the types of security measures and their problems, and in addition, it will also address semi- imputability, which also allows, in some cases, the agent to comply with a security measure, or serve a reduced sentence of one to two thirds.
