Resumo
As mulheres possuem garantias regulamentadas pela Constituição e, portanto, têm o
direito de desenvolver atividades corporativas independente do seu gênero e questões
biológicas. O direito da mulher no mercado de trabalho está descrito no artigo 7º, inciso XX,
que tem como objetivo proteger e incentivar as mulheres neste âmbito. Há uma preocupação
constitucional sobre este direito e sobre a inserção da mulher. Mesmo que exista um capítulo
inteiro na CLT dedicado a assegurar o direito da mulher, há muitos impedimentos no papel das
mulheres no mercado de trabalho, inclusive nos setores que são compostos, em sua maior parte,
por homens, como tecnologia e economia, por exemplo. Mesmo com dispositivos que visam
mitigar a discriminação, há obstáculos na participação feminina ativa neste meio. Este artigo
busca enfatizar e analisar esses problemas enfrentados, considerando que por mais que haja
progresso, os desafios permanecem, incluindo problemas para sua evolução, pouca
representatividade nos cargos executivos e de liderança. A pesquisa busca desdobrar os
principais pontos de dificuldade, enfrentados pelas mulheres, como sexismo, assédio moral e
sexual. Esses impedimentos são vistos como obstáculos para a evolução das mulheres no
mercado de trabalho e têm consequências diretas em sua saúde mental e progresso pessoal. Será
destacado neste trabalho questões relacionadas ao assédio sexual e moral e suas consequências
sobre as vítimas, bem como as mudanças necessárias para que se mude essa realidade.
Women have guarantees regulated by the Constitution and, therefore, have the right to develop corporate activities regardless of their gender and biological issues. Women's rights in the labour market are described in Article 7, item XX, which aims to protect and encourage women in this area. There is a constitutional concern about this right and about the inclusion of women. Even though there is an entire chapter in the CLT dedicated to ensuring women's rights, there are many impediments to the role of women in the labor market, including in sectors that are mostly composed of men, such as technology and economics, for example. Even with provisions that aim to mitigate discrimination, there are obstacles to active female participation in this environment. This article seeks to emphasize and analyze these problems, considering that as much progress as there is progress, challenges remain, including problems for its evolution, little representation in executive and leadership positions. The research seeks to unfold the main points of difficulty faced by women, such as sexism, moral and sexual harassment. These impediments are seen as obstacles to women's evolution in the labor market and have direct consequences on their mental health and personal progress. This paper will highlight issues related to sexual and moral harassment and its consequences on victims, as well as the changes needed to change this reality
