Resumo
Os criptoativos representam hoje, uma das maiores inovações dos últimos tempos, além disso,
a tecnologia blockchain tem o potencial de revolucionar muitos processos usualmente
mecânicos, caros e trabalhosos, através da eliminação de intermediários. Tamanha a sua
inovação e sua crescente utilização, o mercado dos criptoativos já soma trilhões de dólares
investidos1 (conforme valor de mercado calculado com base em 21.555 criptomoedas pela
plataforma CoinMarketCap), que a regulamentação passa a se tornar um tópico de debate
constante.
O presente trabalho, visando dar enfoque jurídico a esse novo mundo, busca, entre outros
pontos: (a) comparar o estágio das legislações dos criptoativos ao redor do mundo; (b) analisar
as principais decisões da Comissão de Valores Mobiliários e da Securities and Exchange
Comission dos Estados Unidos; e (c) analisar o Projeto de Lei nº 4401/21, atualmente em
votação no Congresso Nacional.
Em síntese, este trabalho funciona como um grande resumo do arcabouço regulatório dos
criptoativos hoje no Brasil, procurando também trazer os principais aspectos que podem vir a
ser regulados, juntamente com os seus benefícios e malefícios.
Cryptoassets represents one of the greatest innovations of recent times; moreover, blockchain technology is capable of revolutionizing many, usually, mechanical, expensive, and laborintensive processes by eliminating intermediaries. Given its innovation and growing use, the crypto-active market has already reached trillions of dollars invested2 (according to the market value calculated based on 21,555 cryptocurrencies by the CoinMarketCap platform), regulation has become a topic of constant debate. This work, aiming to give a legal focus to this new world, seeks, among other things: (a) to compare the stage of legislation on cryptoassets around the world; (b) to analyze the main decisions of the Securities and Exchange Commission of the United States and the Securities and Exchange Commission of Brazil; and (c) to analyze Bill 4401/21, currently being voted in Congress. In synthesis, this paper works as a great abstract of the regulatory framework of cryptoassets today in Brazil, also trying to bring the main issues that may come to be regulated, along with their benefits and harms.
