A (im)penhorabilidade do bem de família do fiador em casos de dívidas decorrentes
de contratos de locação é um tema que sempre causou polêmica entre a doutrina e a
jurisprudência. Com o advento da Emenda Constitucional n° 26/2006, o Supremo Tribunal
Federal foi provocado para dizer acerca da constitucionalidade da norma que determina que é
penhorável o bem de família do fiador em contratos de locação (art. 3°, VII, da Lei n° 8.009/90).
Na ocasião, decidiu-se pela constitucionalidade. Todavia, no ano de 2018, por decisão da
maioria da 1ª Turma do STF, analisou-se novamente a questão e decidiu-se que, no que se refere
aos contratos de locação comercial, a norma prevista no art. 3°, VII, da Lei n° 8.009/90 não é
aplicável. A partir da mencionada decisão, restam alguns questionamentos: teria o Supremo
Tribunal Federal agido além de suas funções, ao dizer algo que não está escrito no texto legal?
Qual o efeito da decisão perante os Tribunais inferiores? O presente estudo objetiva refletir
acerca dos questionamentos retro mencionados, a fim de respondê-los a partir da análise
conceitual dos temas ligados à matéria, bem como da análise do Recurso Extraordinário n°
605.709/SP.
The impossibility of attachment of the guarantor's family property in cases of debts arising from rental agreements is a topic that has always caused controversy between doctrine and jurisprudence. With the advent of Constitutional Amendment No. 26/2006, the Supreme Federal Court was provoked to say about the constitutionality of the rule that determines that the guarantor's family property is subject to attachment in rental agreements (art. 3, VII, of the Law No. 8.009 / 90). At the time, it was decided on constitutionality. However, in 2018, by decision of the majority of the 1st Panel of Judges of the Supreme Court, the issue was analyzed again and it was decided that, with regard to commercial rental contracts, the rule provided for in art. 3, VII, of Law No. 8.009 / 90 is not applicable. As of the aforementioned decision, some questions remain: did the Federal Supreme Court act beyond its functions, by saying something that is not written in the legal text? What is the effect of the decision before the lower Courts? This study aims to reflect on the aforementioned questions in order to answer them from the conceptual analysis of the themes related to the matter and the analysis of Extraordinary Appeal No. 605.709 / SP.
