O consentimento do menor de 14 anos no delito do art. 217-a do Código Penal e a incompatibilidade da súmula 593 do STJ com os princípios de direito penal mínimo

A pesquisa pretendeu analisar a presunção de vulnerabilidade absoluta do menor de 14 anos no crime do Art. 217-A do Código Penal conforme a Súmula 593 do STJ e a incompatibilidade desta com os princípios do Direito Penal Mínimo. Além disso, analisou a divergência jurisprudencial em relação à capacidade do menor de 14 anos de consentir à prática do ato sexual e à validade deste consentimento para afastar o delito de estupro de vulnerável, levando, posteriormente, à edição da Súmula 593 do Superior Tribunal de Justiça que consagrou a presunção de violência do delito. Por fim, este artigo pretendeu analisar o consentimento das vítimas e inadequação da Súmula 593 nos casos que, em tese, inexistiria lesão ao bem jurídico tutelado pelo artigo 217-A do Código Penal, qual seja, a dignidade sexual do adolescente diante dos princípios do Direito Penal Mínimo de intervenção mínima, ofensividade e adequação social.
The research intended to analyze the absolute presumption of vulnerability of the minor under 14 years of age in the crime of the article 217-A of the Brazilian Criminal Code according to the Precedent no. 593 of the Superior Court of Justice and its incompatibility with the principles of Minimum Criminal Law. Furthermore, it analyzed the jurisprudential divergence in relation to the capacity of minors under 14 years of age to consent to the practice of sexual intercourse and the validity of this consent to invalidate the crime of rape against vulnerable people, subsequently leading to the edition of Precedent no. 593 by the Superior Court of Justice that stated the presumption of absolute vulnerability in the crime. Finally, this article intended to analyze the victims‘ consent and the inadequacy of the Precedent no. 593 in cases which, in theory, there would be no harm to the legal interest protected by the article 217-A of the Criminal Code, that is, the adolescent‘s sexual dignity according to the principles of Minimum Criminal Law, such as minimum intervention, offensiveness and social adequacy.
