Resumo
O presente trabalho visa melhor compreender um assunto pouco discutido, em
razão de sua natureza discreta e articulada na atuação, mas que gera bilhões de
dólares ao tráfico no período de um ano devido à habilidade dos criminosos de se
adaptarem ao contexto que se encontram, este crime é o Tráfico de Pessoas, cujo
enfoque é para fins de exploração sexual, a mais recorrente. No primeiro momento,
busca-se explicitar o conceito atual de Tráfico Humano e a relação entre este e a
vulnerabilidade das vítimas, ou seja, o que as tornam mais suscetíveis a serem
vítimas desta modalidade criminosa. Nota-se que majoritariamente as vítimas são do
sexo feminino e, surpreendentemente, uma expressiva parcela é composta por
crianças e adolescentes. Frente a isso, há de ser discutida a relevância do
consentimento para que se configure a conduta em questão e como isso ocorre no
caso de a vítima ser criança, ou mesmo adolescente. Destaca-se, também, o
conceito de condutas que estão diretamente atreladas ao Tráfico de Pessoas, como
o Lenocínio, o Rufianismo e a Prostituição. Além disto, fala-se sobre como o
consumidor de pornografia digital contribui com o desaparecimento e alienação de
direitos das vítimas, que se tornam atrizes pornô de grandes produtoras. Finalmente,
é de suma importância a compreensão dos tratados, convenções e, posterior
legislação no combate ao Tráfico de Pessoas, a participação ativa de membros da sociedade civil (associados à ONGs/OSCs, ou não) e instituições privadas por meio
das PPPs.
ABSTRACT: The actual work aims to better understand a little about the discussed subject due to its discreet and articulated nature in the action that generates billions of dollars on trafficking in a period of a year due to the ability of criminals to adapt to the context they are in. The most common crime is Human Trafficking in which focuses on sexual exploitation. At first, the research seeks to clarify the current concept of Human Trafficking and the relationship between this and the vulnerability of victims, which is what makes them more susceptible to being victims of this criminal modality. It is noted that the majority of victims are female and, surprisingly, a significant portion is made up of children and adolescents. In view of this, the relevance of consent to configure the conduct in question and how this occurs in the case of the victim being a child, or even an adolescent, must be discussed. Also noteworthy is the concept of behaviors that are directly linked to human traffickings, such as Pimping, Ruffianism, and Prostitution. Furthermore, the research shows how the consumer of digital pornography contributes to the disappearance and alienation of the rights of victims, who become porn actresses for major producers. Finally, it is extremely important to understand the treaties, conventions, and subsequent legislation in the fight against Human Trafficking and the participation of members of civil society (associated with ONGs/OSCs, or not) and private institutions through PPPs.
