Resumo
Em apertada síntese, o presente trabalho tem como escopo analisar os critérios e
limites da utilização de medidas atípicas no processo executivo. Para a compreensão
do tema, o trabalho se inicia com uma breve análise histórica do processo executivo
e as medidas típicas de execução, além da evolução legislativa gradual que
possibilitou a adoção de medidas atípicas para a obtenção da tutela jurisdicional
pretendida. Após tal análise, é feito um breve raciocínio sobre as estatísticas
processuais em âmbito nacional e a necessidade de se adotar mecanismos que fujam
da regra para a obtenção satisfatória da tutela jurisdicional sob o prisma da razoável
duração do processo. Em seguida, passa-se à análise do assunto sob a perspectiva
legal atual, com o advento da Lei nº 13.105, de 16 de março de 2015, denominada de
“Novo Código de Processo Civil”, o qual possui ferramentas genéricas que ampliam o
leque de possibilidades na condução do processo executivo. Em continuidade, o
trabalho se debruça sobre os pressupostos para a adoção de medidas atípicas, bem
como os limites de sua utilização. Por fim, analisa-se julgados do Tribunal de Justiça
do Estado de São Paulo e do Superior Tribunal de Justiça, o entendimento
jurisprudencial sobre o tema, sua evolução e possíveis projeções futuras, partindo
para a conclusão do presente trabalho.
In summary, the objective of this work is to analyze the criteria and limits of the use of atypical measures in the execution procedures. To understand the theme, the work begins with a brief historical analysis of the executive process and the typical measures of execution, in addition to the gradual legislative evolution that made it possible to adopt atypical measures to obtain the intended jurisdictional protection. After that, a brief reasoning is made about the procedural statistics at national level and the need to adopt mechanisms that deviate from the rule to obtain satisfactory judicial protection under the prism of the reasonable duration of the process. Then, the subject is analyzed from the current legal perspective, with the advent of Law No. 13,105, of March 16, 2015, as known as “New Civil Procedure Code”, which has generic tools that expand the range possibilities in conducting the executive process. In continuing, the work looks at the prerequisites for the adoption of atypical measures, as well as the limits of their use. Finally, the work analyzes judgments of the São Paulo State Court of Justice and the Superior Court of Justice, the jurisprudential understanding on the theme, its evolution and possible future projections, walking to the conclusion of the present work.
