Resumo
O presente trabalho discute o impacto da Inteligência Artificial (IA) na indústria
musical, enfocando a profundidade das transformações ocasionadas por essa tecnologia. A
aplicação da IA na criação de obras musicais tem gerado uma série de questionamentos sobre
a adequação da legislação vigente de Direitos Autorais e as implicações éticas envolvidas nesse
processo. A atual legislação, concebida em um contexto em que a criação musical era
predominantemente humana, revela lacunas e inadequações significativas diante das novas
formas de criatividade emergentes.
A ascensão da IA na produção musical também desafia conceitos tradicionais de autoria, pois
possibilita a criação de obras de maneira autônoma, sem intervenção humana direta. Isso
levanta questões fundamentais sobre a atribuição de autoria de uma obra criada pela IA
evidenciando a necessidade de revisar as definições legais existentes.
Ademais, a criação musical via IA envolve complexidades éticas, especialmente no que tange
à replicação e distribuição em massa dessas obras, o que pode depreciar o valor de criações
originais e explorar o trabalho de artistas humanos. Essas considerações destacam a necessidade
de um debate cuidadoso e responsável.
Para abordar essa temática, será empregada uma metodologia que combina o uso de pesquisa
bibliográfica e análise de casos. Tal abordagem facilitará um entendimento mais profundo, tanto
teórico quanto prático, da aplicação das leis de Direitos Autorais à produção musical induzida
por IA. A pesquisa bibliográfica será realizada através de uma revisão sistemática da literatura
existente sobre IA, Direitos Autorais e a indústria musical, envolvendo fontes acadêmicas,
relatórios governamentais, legislação, artigos jornalísticos e conteúdos online, oferecendo uma
visão abrangente da questão.
This study discusses the impact of Artificial Intelligence (AI) on the music industry, highlighting the depth of the transformation that this technology has brought about. The application of AI in the creation of musical works has generated a series of questions about the adequacy of copyright legislation and the ethical implications involved in this process. Current legislation, conceived in a context in which musical creation was predominantly human, reveals gaps and inadequacies in the face of emerging new forms of creativity. The rise of AI in music production also challenges traditional concepts of authorship, since it can create works independently, without direct human intervention. This raises fundamental questions about who should be considered the true author of a work created by AI, highlighting the need to rethink existing legal definitions. In addition to legal issues, there are also complex ethical considerations involved in AI music creation. The ease of replication and large-scale distribution of these works can depreciate the value of original creations and potentially exploit the work of human artists, highlighting the importance of addressing these issues carefully and responsibly. The methodology used to approach the topic will be a combination of bibliographical research and case analysis. This approach will allow for an in-depth understanding of both the theory and practice involved in applying copyright law to music creation generated by Artificial Intelligence (AI). The bibliographical research will be carried out through a systematic review of existing literature on AI, copyright and the music industry. Academic sources, government reports, laws, news articles and online texts will be consulted to provide an overview of the subject.
