The present work aimed at a literary historical study of the work “Pride and Prejudice”, by Jane Austen, in order to understand why women were prevented from inheriting properties, as in the case of the Bennet sisters. This theme, central to the work in question, was systematized for the first time by Sir William Blackstone, the first professor of English law at the University of Oxford, in England and the main reference to law at the time. It was understood that Austen was a figure who wrote about what he knew; about his reality and, for this reason, questions like this are so central in his works. Still, it is possible to see that her writing style generated several debates, which persist until today, about whether she was a critical or conformist figure in relation to her time, especially with regard to the role of women.
