Essa pesquisa destaca a evolução da responsabilidade civil dos bancos, adaptando-se às
transformações sociais, tecnológicas e econômicas, para manter a indenização e reparação de
danos a terceiros. Ressalta-se a responsabilidade bancária em prevenir danos sociais e
econômicos, apresentam-se casos jurisprudenciais de falhas na prestação de serviços, fraudes e
práticas abusivas, demonstra-se o dever das instituições financeiras de assegurar a segurança
das operações e a proteção dos consumidores. As perguntas formuladas abrangem a evolução
do conceito de indenização, as condições para a emergência da responsabilidade civil, o
desenvolvimento e influência da teoria de responsabilidade pré-contratual, os deveres
complementares ao contrato, a influência da boa-fé objetiva, a transformação da
responsabilidade civil ao longo do tempo, a origem e significado da responsabilidade civil, a
fundamentação no Código Civil, a influência da globalização e competição, os efeitos da
informação assimétrica e lealdade dos clientes, os riscos associados ao setor bancário
evidenciados pela crise financeira global, o papel social dos bancos e sua adaptação ao longo
do tempo, as responsabilidades civis das instituições bancárias em suas operações e serviços.
As respostas alcançadas demonstram que a responsabilidade civil dos bancos engloba desde a
diligência pré-contratual até a proteção contra fraudes e práticas abusivas, reforçando a
necessidade de condutas bancárias alinhadas com a ética, transparência e justiça, visando a
proteção dos consumidores e a estabilidade econômica e social.
This research highlights the evolution of banks’ civil liability, adapting to social, technological, and economic transformations, to maintain compensation and repair of damages to third parties. It emphasizes the bank’s responsibility in preventing social and economic damages, presents jurisprudential cases of failures in the provision of services, frauds, and abusive practices, demonstrates the duty of financial institutions to ensure the security of operations and consumer protection. The questions formulated cover the evolution of the concept of compensation, the conditions for the emergence of civil liability, the development and influence of the theory of pre-contractual liability, the duties complementary to the contract, the influence of objective good faith, the transformation of civil liability over time, the origin and meaning of civil liability, the foundation in the Civil Code, the influence of globalization and competition, the effects of asymmetric information and customer loyalty, the risks associated with the banking sector evidenced by the global financial crisis, the social role of banks and their adaptation over time, the civil responsibilities of banking institutions in their operations and services. The answers achieved demonstrate that the civil liability of banks encompasses from pre-contractual diligence to protection against frauds and abusive practices, reinforcing the need for banking conduct aligned with ethics, transparency, and justice, aiming at the protection of consumers and economic and social stability.
