Resumo
Este trabalho tem como objetivo estudar o instituto do trade dress no ordenamento
jurídico brasileiro e americano. No estudo, foi utilizado jurisprudências, legislações,
tratados, convenções e doutrinas de ambos os países. Primeiramente, foi feita uma
breve introdução sobre a propriedade intelectual do Brasil e dos Estados Unidos,
tendo em vista que o trade dress se relaciona com ele. Com o auxílio dessa análise,
foi possível então estudar casos julgados pela Corte Americana e Brasileira, com
designo de averiguar o que foi adotado sobre o tema em cada país. Ao término do
estudo constatou que esse instituto é de extrema relevância para o Direito Empresarial
no Brasil e para o Direito sobre a Propriedade Intelectual nos Estados Unidos, e foi
observado também que o trade dress está intrinsecamente ligado com a repressão da
concorrência desleal. Levando em conta o que foi observado, pode-se concluir que a
jurisprudência americana se encontra mais concreta sobre o assunto, enquanto no
Brasil uma edição de diploma legal sobre o tema pode vir a auxiliar na solução dos
casos concretos.
This final paper aims to study the trade dress institute in the Brazilian and American legal systems. In the study, jurisprudence, legislation, treaties, conventions, and doctrines from both countries were used. First, a brief introduction was made on the intellectual property of Brazil and the United States, considering that the trade dress is related to it. With the aid of this analysis, it was then possible to study lawsuits hidden by the American and Brazilian Court, to ascertain what was adopted on the subject in each country. At the end of the study, it was found that this institute is extremely relevant for Corporate Law in Brazil and Intellectual Property Law in the United States, and it was also observed that the trade dress is intrinsically linked to the repression of unfair competition. Taking into account what has been observed, it can be concluded that American jurisprudence is more concrete on the subject, while in Brazil an edition of a legal diploma on the subject may come to assist in the solution of specific lawsuits
