Resumo
Os acordos de colaboração premiada vêm sendo utilizados em grande escala, sob a premissa de
combater o crime organizado. Nos moldes atuais da legislação penal brasileira, verificam-se
diversas ilegalidades e inconstitucionalidades na fixação das cláusulas e na concessão de
prêmios. Desse modo, o presente estudo tem como objeto a colaboração premiada, que será
analisada através do seu conceito, evolução no ordenamento jurídico e aspectos procedimentais.
Através da metodologia da pesquisa bibliográfica, analisou-se o regramento legal e
constitucional da colaboração premiada. Para tanto, utilizou-se o princípio do devido processo
legal, partindo de seu conceito até as classificações. Por fim, apreciou-se os aspectos legais da
colaboração premiada sob os mandamentos do devido processo legal, com ênfase no direito ao
silêncio, contraditório e ampla defesa e duplo grau de jurisdição. A partir dessa análise,
concluiu-se que a colaboração premiada, nos moldes legais que se encontra hoje, está em
dissonância com a Constituição Federal. Tecem-se críticas quanto à aplicação deste instituto
pela Justiça Brasileira. Ao final, propuseram-se alterações legislativas e soluções práticas para
adequar esse instituto à Constituição Federal.
The collaboration agreements have been used on a large scale under the premise of combating organized crime. In the current line of the Brazilian criminal legislation, there are several illegalities and unconstitutionalities in the setting of clauses and in the awarding of prizes. Therefore, the present study has as its object the collaboration agreements, which will be analyzed through its concept, evolution in the legal system and procedural aspects. Through the bibliographic research methodology, the legal and constitutional rule of the awarded collaboration is analyzed. For that, the principle of due process is used, starting from its concept to the classifications. Finally, the legal aspects of the collaboration agreements under the commandments of due process are appreciated, with emphasis on the right to silence, contradictory and broad defense and double degree of jurisdiction. From this analysis, it is concluded that the collaboration agreements, in the legal lines in which it is today, is in dissonance with the Federal Constitution. Criticism is expressed regarding the application of this institute by the Brazilian Justice. Lastly, legislative changes and practical solutions are proposed to adapt this institute to the Federal Constitution.
