Abstract
O crescente número de recursos protocolados no Superior Tribunal de Justiça (STJ) levou à
promulgação da emenda constitucional n° 125 em julho de 2022. Essa emenda trouxe
mudanças significativas para o recurso especial no Brasil, incluindo a introdução do quesito
de relevância como condição para a interposição de Recurso Especial perante o STJ. O
Recurso Especial é uma ferramenta fundamental para a revisão de decisões dos Tribunais
Estaduais ou Regionais Federais pelo STJ. No entanto, a emenda constitucional n° 125 tem
sido alvo de críticas e controvérsias, uma vez que alguns argumentam que o quesito de
relevância pode dificultar o acesso à justiça, pois casos importantes podem ser considerados
irrelevantes pelo STJ e não serem analisados.
The growing number of appeals filed with the Superior Court of Justice (STJ) led to the promulgation of Constitutional Amendment No. 125 in July 2022. This amendment brought significant changes to the special appeal process in Brazil, including the introduction of the relevance requirement as a condition for filing Special Appeals before the STJ. The Special Appeal is a crucial tool for reviewing decisions made by State and Regional Federal Courts at the STJ. However, Constitutional Amendment No. 125 has been the subject of criticism and controversies, as some argue that the relevance requirement may hinder access to justice since important cases could be deemed irrelevant by the STJ and not reviewed.
