A presente pesquisa tem como foco principal abordar a impossibilidade de reconhecimento do
vínculo empregatício entre as plataformas digitais e os motoristas de aplicativos. A abordagem
do impedimento do vínculo, justifica-se com base, no crescimento da cultura de
compartilhamento e com isso, o surgimento de grandes empresas de economia compartilhada,
como é o exemplo da Uber e 99 POP. Essas empresas estão em constante crescimento, dessa
forma, têm movimentando a economia mundial e influenciados diversas formas de negócio,
revolucionando o mercado com forte impacto nas relações de trabalho. Com o levantamento e
análise de informações ao longo do estudo foi possível concluir que nenhum dos requisitos
previstos nos arts. 2º e 3º da CLT, estão presente na relação desenvolvida entre as plataformas
e os motoristas. Sendo assim, é correto afirmar a impossibilidade de reconhecimento dos
motoristas de aplicativos, como empregados das plataformas digitais de transporte.
This research has as main focus to address the impossibility of recognizing the employment bond between digital platforms and application drivers. The approach of preventing the link is justified based on the growth of the culture of sharing and with this, the emergence of large companies of shared economy, as is the example of Uber and 99 POP. These companies are constantly growing, so they have moved the world economy and influenced various forms of business, revolutionizing the market with a strong impact on labor relations. With the survey and analysis of information throughout the study it was possible to conclude that none of the requirements foreseen in arts. 2nd and 3rd of CLT, are present in the relationship developed between platforms and drivers. Therefore, it is correct to affirm the impossibility of recognizing application drivers, as employees of digital transportation platforms.
