O presente trabalho se propõe a estudar os aspectos relevantes que cercam a execução
provisória da pena, como as normas e princípios do processo penal, em especial o princípio da
presunção de inocência, em conjunto com os Tratados Internacionais, para que seja possível
fazer uma análise crítica sobre o julgamento das Ações Declaratórias de Constitucionalidade
n.º 43, 44 e 54, pelo Supremo Tribunal Federal. Ainda em caráter introdutório, serão
observadas atentamente as características do procedimento do Tribunal do Júri, o qual detém
competência especial para julgamento dos crimes dolosos contra a vida, conforme instituído
na Constituição Federal em seu art. 5º, XXXVIII, bem como os princípios próprios
relacionados, sendo eles, o sigilo das votações, que garante a idoneidade da convicção dos
jurados, a plenitude de defesa, que garante ao acusado todo o possível dentro da legalidade
para que possa manter seu status de inocência, bem como a soberania dos veredictos, a qual
confere às decisões proferidas pelo Tribunal Popular máxima eficácia e intangibilidade de
mérito por juízes togados. Com todo este contexto, buscamos analisar de forma crítica os
aspectos positivos e negativos da execução provisória da pena em se tratando de condenação
proferida pelo Tribunal do Júri, questão atualmente pendente de julgamento nos autos do
Recurso Extraordinário com caráter de repercussão geral n.º 1.235.340/SC, como forma de
ponderar os princípios que mais interessam defender perante a ordem constitucional para que
seja feita a justiça, de modo mais abrangente e fundamentalista do que tão somente dispõe a
letra da lei.
The present study sought to demonstrate the relevant aspects that involve the provisional enforcement of the condemnatory sentence, such as the rules and principles of criminal procedure, in particular the principle of presumption of innocence, together with the International Treaties, to be possible make a critical analysis on the judgment of Constitutionality Declaratory Actions numbers 43, 44 and 54, by Brazilian Supreme Court. Also as an introduction, the characteristics of the Jury Trial procedure will be carefully observed, which has special jurisdiction to judge intentional crimes against life, as established in the Federal Constitution, in its articule 5, XXXVIII, as well as the related principles, such as the secrecy of the votes, which guarantees the trustworthiness of the jurors conviction, the fullness defense, which guarantees for the defendant everything as possible within the legality to maintain his status of innocence, and the sovereignty of the verdicts, which gives for decisions rendered by the Jury Trial maximum effectiveness and intangibility of merit even by any professional judge. With this whole context, we seek to made a critical analysis of the positive and negative aspects of provisional execution of the sentence rendered by the Jury Trial, a question currently pending judgment in the record of the Extraordinary Appeal with general repercussion n.º 1.235.340/SC, in order to measure the constitutional principles that are more important to defend to make justice, in a more embracing and fundamentalist manner than just the letter of the law provides.
