Em junho de 2018, a Quinta Câmara Criminal do Tribunal de Justiça do Estado de
Santa Catarina apreciou habeas corpus impetrado em favor de indivíduo que, após autorização
judicial, teve seu telefone celular brevemente apreendido pela polícia, a qual efetivou o
“espelhamento” de seu aplicativo WhatsApp. Em decorrência das conversas obtidas, o
investigado teve a prisão preventiva decretada pela prática de tráfico de entorpecentes e
associação para o tráfico. Após a ciência de toda a investigação, sua defesa buscou a anulação
da decisão que autorizou o “espelhamento”, bem como de todas as provas dele decorrentes. No
entanto, a Corte Estadual denegou a ordem, o que ensejou a interposição de recurso ordinário
em habeas corpus e culminou na anulação – pela Sexta Turma do Superior Tribunal de Justiça
– de todas as provas e no trancamento do inquérito policial. Nesse contexto, o presente trabalho
busca analisar a existência de previsão legal para o “espelhamento” do WhatsApp, objetivando
apurar sua natureza jurídica e – se o caso – estabelecer quais seus requisitos, limites e
problemas.
In June 2018, the Fifth Criminal Chamber of the Santa Catarina State Court of Justice ruled an habeas corpus filed in favor of an individual who, after judicial authorization, had his cell phone briefly seized by the police, which “mirrored” his WhatsApp application. As a result of the conversations obtained, the individual was put in pre-trial detention for the practice of drug trafficking and association for trafficking. After becoming aware of the investigation, his defense sought to annul the decision that authorized the “mirroring”, as well as all the resulting evidence. However, the State Court denied the writ, which led to the filing of an habeas corpus appeal and culminated in the annulment – by the Sixth Panel of the Superior Court of Justice – of all evidence and in the halting of the police investigation. In such context, the present work intends to analyze the existence of a legal provision for the “mirroring” of WhatsApp, in order to ascertain its legal nature and – if applicable – establish its requirements, limits and problems.
