O problema da reincidência criminal é reconhecido em todo o Brasil, mesmo diante de todas as
garantias asseguradas aos reclusos, operacionalizados por políticas públicas que protegem a
dignidade humana do condenado, a garantia de seus direitos e estabelecem a responsabilidade
do Estado na ressocialização a fim de reduzir a reincidência. Portanto, quais motivos levariam
os indivíduos a praticar novos crimes após cumprirem suas sentenças? O presente estudo busca
entender essa questão através da ineficácia da ressocialização como um dos fatores
determinantes da reincidência criminal. Foram analisadas diversas disposições legais no âmbito
da privação de liberdade, dados e relatos sobre a atual situação carcerária no Brasil a fim de
verificar a aplicabilidade das leis e políticas públicas de ressocialização que visam reduzir a
reincidência, e foi possível observar que a realidade carcerária é incompatível com o idealismo
legal e que a ressocialização não é atingida pelo Estado de modo que, apesar de não ser o única,
é uma das razões que contribuem para que estes indivíduos voltem a praticar novos delitos.
The problem of criminal recidivism is recognized throughout Brazil even given all the guarantees provided to prisoners, operationalized by public policies that protect the human dignity of the condemned, the guarantee of their rights and establish the State’s responsibility on achieving resocialization in order to reduce recidivism. So, what could be the reasons that would lead individuals to practice new crimes after serving their sentences? This study seeks to understand this issue through the ineffectiveness of criminal resocialization as one of the determinants of criminal recidivism. Several legal provisions were analyzed in the scope of liberty deprivation, data and reports on the current prison situation in Brazil, in order to verify the applicability of resocialization laws and public policies that aims to lower criminal recidivism. It was possible to observe that the prison reality is incompatible with legal idealism and that the goal of resocialization is not adequately met by the State, so that despite not being the only one, it is one of the reasons that contributes to these individuals to practice new crimes.
