| dc.description.abstract | O objetivo central deste estudo é buscar o conceito e a abrangência da segurança jurídica coletiva, demonstrando possuir um conteúdo normativo necessário para regular as questões de direito intergeracional. Pretende-se demonstrar que os elementos normativos da sustentabilidade e da responsabilidade intergeracional até aqui desenvolvidas apresentam inconsistências fundamentais decorrentes do seu campo de regulação e do seu caráter formal. Nesse contexto, a segurança jurídica coletiva apresenta uma densidade normativa superior, com maior concretude material que proporciona maior equilíbrio do sistema jurídico, utilizando-se dos fundamentos da sustentabilidade e da responsabilidade intergeracional, formando um elo imprescindível entre eles por força do pensamento lógico de continuidade da existência em sociedade. O foco central do estudo consiste em superar a visão da segurança jurídica sob aspecto meramente individualista, que tem marcado sua aplicação com vistas apenas a direitos individuais, afirmando-se a necessidade da compreensão da segurança jurídica sob uma perspectiva coletiva (em sentido amplo, metaindividual), que deve ser compreendida como fundamento para a sustentabilidade e para a responsabilidade intergeracional. Essa compreensão coletiva da segurança jurídica na regulação de questões intergeracionais encontra amparo nas normas da Constituição Federal de 1988, como a da solidariedade e a própria previsão da segurança dentre os direitos fundamentais individuais e coletivos do art. 5º da CF, dentre outras. Os estudos serão desenvolvidos pelo método indutivo, com fundamento em análise bibliográfica, normativa, documental e jurisprudencial. Aderente à linha de pesquisa Cidadania modelando o Estado do Programa de Pós-graduação em Direito Político e Econômico da Universidade Presbiteriana Mackenzie, este estudo começa destacando a importância do princípio geral da segurança jurídica, ínsito ao sobreprincípio do Estado Democrático de Direito em decorrência do Título II, Capítulo I e art. 5º, caput, dentre outros, da Constituição da República de 1988, informando a interpretação e aplicação de todo o ordenamento jurídico. Elabora-se breve estudo de suas origens, sua natureza, seus conteúdos normativos e sua função instrumental para efetivação da dignidade humana e da justiça social, formulando o conceito de segurança jurídica. Os estudos, então, desenvolvem-se demonstrando a existência de segurança jurídica em âmbito coletivo, definindo que seu objeto de incidência é inerente aos direitos fundamentais coletivos, difusos e individuais homogêneos, passando-se a verificar a importância concreta dessa concepção coletiva da segurança jurídica mediante a abordagem de algumas espécies de direitos, bem como a sua relação com a sustentabilidade e com a responsabilidade intergeracional. Conclui-se com a formulação do conceito de segurança jurídica coletiva e com a demonstrando da sua posição superior para regular as questões de direito intergeracional, informando e suprindo as deficiências das teorias da sustentabilidade e da responsabilidade intergeracional até aqui desenvolvidos, mediante a oferta de sua maior concretude normativa e de sua melhor eficácia e adequação para condução a um equilíbrio do sistema jurídico. | |

| local.description.abstracten | The central objective of this study is to search the concept and scope of collective legal certainty, demonstrating that it has a necessary normative content to regulate issues of intergenerational law. It is intended to demonstrate that the normative elements of sustainability and intergenerational responsibility so far present fundamental inconsistencies arising from their field of regulation and their formal nature. In this context, collective legal security has a higher normative density, with greater material concreteness that provides greater balance in the legal system, using the foundations of sustainability and intergenerational responsibility, forming a permanent link between them through the strength of logical thought of continuity of existence in society. The central focus of the study is to overcome the view of legal certainty from a merely individualistic perspective, which has marked its application with a view only to rights, asserting the need to understand legal certainty from an individual collective perspective (in a broad sense, meta-individual), which must be understood as a foundation for sustainability and intergenerational responsibility. This collective understanding of legal security in the regulation of intergenerational issues is supported by the norms of the Federal Constitution of 1988, such as solidarity and the very provision of security within the fundamental individual and collective rights of art. 5 of the CF, among others. The studies will be included by the inductive method, based on bibliographical, normative, documental and jurisprudential analysis. Adhering to the line of research Citizenship shaping the State of the Graduate Program in Political and Economic Law at Universidade Presbiteriana Mackenzie, this study begins by highlighting the importance of the general principle of legal certainty, inherent to the overprinciple of the Democratic State of Law as a result of the Title II, Chapter I and art. 5, caput, among others, of the Constitution of the Republic of 1988, informing the interpretation and application of the entire legal system. A brief study of its origins, its nature, its normative contents and its instrumental function for the realization of human dignity and social justice is elaborated, formulating the concept of legal security. The studies, then, are developed demonstrating the existence of legal certainty in a collective scope, defining that its object of incidence is inherent to the fundamental collective, diffuse and homogeneous individual rights, going on to verify the concrete importance of this collective conception of legal certainty by approaching some types of rights, as well as their relationship with sustainability and intergenerational responsibility. It concludes with the formulation of the concept of collective legal certainty and with the demonstration of its superior position to regulate issues of intergenerational law, informing and supplying the deficiencies of the theories of sustainability and intergenerational responsibility developed until now, through the offer of its greater normative concreteness and its better effectiveness and suitability for leading to a balance of the legal system.Collective Legal Security | |
