Resumo
Este trabalho propõe-se a explorar a importância do estudo e prevenção da violência contra a
integridade física e moral da mulher durante os períodos de gestação, parto e pós-parto,
perpetrados tanto por profissionais da saúde quanto por outros agentes envolvidos nesse
contexto, sejam eles do setor público ou privado. Devido à falta de divulgação e conscientização
sobre o assunto, bem como às dificuldades práticas em provar tais ocorrências, muitas mulheres
podem nem mesmo ter ciência de que foram vítimas de violência obstétrica, e as consequentes
sanções por esses atos são frequentemente escassas. O objetivo primordial desta pesquisa é
abordar de forma abrangente o conceito de violência perpetrada por profissionais da saúde,
tanto física quanto moral, explorar as possibilidades de responsabilização desses agentes e
analisar a posição dos tribunais brasileiros sobre esse tema complexo e sensível. Ademais,
utilizando-se da metodologia empírico-dialética, a pesquisa baseou-se na análise de artigos,
matérias e livros publicados sobre o assunto, bem como na investigação da jurisprudência
brasileira pertinente. Desta forma, tornou-se evidente a necessidade premente de
conscientização da população, implementação de medidas preventivas e fortalecimento da
punição e responsabilização dos agressores. Além disso, ressaltou-se a importância crucial do
apoio psicológico e da reparação civil para as mulheres agredidas, visando sua recuperação
integral após tais experiências traumáticas.
This article aims to thoroughly explore the importance of studying and preventing violence against the physical and moral integrity of women during pregnancy, childbirth, and postpartum, perpetrated by healthcare professionals and other actors in the healthcare field, both in the public and private sectors. Due to the lack of disclosure and awareness of the subject, as well as the practical difficulties in proving such occurrences, many women may not even be aware that they have been victims of obstetric violence, and the consequent sanctions for these acts are often scarce. The primary objective of this research is to comprehensively address the concept of violence perpetrated by healthcare professionals, both physical and moral, explore the possibilities of holding these agents accountable, and analyze the position of Brazilian courts on this complex and sensitive issue. Additionally, using the empirical-dialectical methodology, the research was based on the analysis of articles, materials, and books published on the subject, as well as the examination of relevant Brazilian jurisprudence. Thus, it became evident the urgent need for public awareness, implementation of preventive measures, and strengthening of punishment and accountability for the perpetrators. Furthermore, the crucial importance of psychological support and civil reparation for abused women was highlighted, aiming at their full recovery after such traumatic experiences.
