Resumo
Este estudo aborda a guarda compartilhada como um mecanismo preventivo contra a alienação parental, analisando sua eficácia no contexto do Direito de Família brasileiro. A alienação parental, caracterizada pela manipulação emocional de uma criança para que rejeite o outro genitor, é uma prática que traz graves consequências para o desenvolvimento psicológico e emocional do menor. A guarda compartilhada, regulamentada pela Lei nº 13.058/2014, visa assegurar a participação equitativa dos pais na vida dos filhos, proporcionando um ambiente familiar mais equilibrado e cooperativo, mesmo após a dissolução conjugal. O estudo explora como a corresponsabilidade promovida pela guarda compartilhada reduz os conflitos entre os genitores e dificulta a implementação de comportamentos alienadores, ao garantir uma convivência próxima e contínua com ambos os pais. A partir da revisão bibliográfica e da análise da legislação, conclui-se que a guarda compartilhada não apenas protege os direitos da criança, mas também favorece seu desenvolvimento integral ao promover um ambiente seguro e emocionalmente estável. Este modelo de guarda, ao se alinhar com o princípio do melhor interesse da criança, mostra-se essencial para a construção de uma estrutura familiar saudável e colaborativa.
This study addresses shared custody as a preventive mechanism against parental alienation, analyzing its effectiveness in the context of Brazilian Family Law. Parental alienation, characterized by the emotional manipulation of a child to reject the other parent, is a practice that has serious consequences for the psychological and emotional development of the child. Shared custody, regulated by Law No. 13,058/2014, aims to ensure the equal participation of parents in the lives of their children, providing a more balanced and cooperative family environment, even after marital dissolution. The study explores how the co-responsibility promoted by shared custody reduces conflicts between parents and hinders the implementation of alienating behaviors, by ensuring close and continuous coexistence with both parents. Based on the literature review and the analysis of the legislation, it is concluded that shared custody not only protects the rights of the child, but also favors their integral development by promoting a safe and emotionally stable environment. This custody model, when aligned with the principle of the best interests of the child, proves to be essential for building a healthy and collaborative family structure.
