O pátrio poder, atualmente denominado poder familiar, foi um dos institutos incorporados pelo
direito civil brasileiro a partir da inspiração do direito português e germânico. A linha
doutrinária define o pátrio poder, em suma, como um conjunto de direitos e obrigações
envolvendo os pais e seus filhos na relação familiar, abarcando questões pessoais e
patrimoniais. Para a produção do presente trabalho, buscou-se dados nas doutrinas de maior
relevância jurídica, iniciando-se com a abordagem conceitual e histórica da concepção
originária, progredindo-se com análise detalhada das características que envolviam o pátrio
poder entre os povos antigos, e relatando as influências sociais para a sua paulatina
transformação. Os estudiosos divergem quanto ao período do nascimento do instituto, bem
assim a justificativa para que, desde quando ele se torna conhecido, tem-se o pai como figura
de destaque. No entanto, com o passar do tempo, o pai deixou a titularidade exclusiva do
exercício do pátrio poder, passando a exercê-la em conjunto à mãe. Os filhos, sujeitos passivos
do exercício, passaram a ser tutelados sem qualquer discriminação. A transformação do
instituto, com a evolução da família, foi inevitável. Assim, prosseguiremos com a análise do
desenvolvimento histórico do instituto no ordenamento jurídico brasileiro, desde o seu
surgimento, até a concepção atual do poder familiar. Detalhando-se as principais legislações,
os sujeitos do instituto, o início e causas de extinção e perda do exercício do pátrio poder, e, por
fim, os reflexos nas relações familiares. Em síntese, pretende-se apresentar o contexto histórico,
jurídico e cultural do nascimento do instituto até os dias atuais, destacando os reflexos sociais
e familiares a partir das transformações da família e do instituto.
The paternal power, currently called family power, was one of the institutes incorporated into brazilian civil law based on inspiration from portuguese law and german law. The doctrinal line defines paternal power, in short, as a set of rights and obligations involving parents and their children in the family relationship, covering personal and patrimonial issues. For the production of the present work, data was sought in the doctrines of greatest legal relevance, starting with a conceptual and historical approach to the original conception, progressing with a detailed analysis of the characteristics that involved the national power among ancient peoples, and reporting social influences for its gradual transformation. Scholars differ as to the period in which the institute was born, as well as the justification for why, since when it became known, the father has been a prominent figure. However, with the passage of time, the father left exclusive ownership of the exercise of paternal power, starting to exercise it jointly with the mother. The children, passive subjects of the exercise, began to be protected without any discrimination. The transformation of the institute, with the evolution of the family, was inevitable. Thus, we will analyze of the historical development of the institute in the brazilian legal system, from its emergence to the current conception of family power. Detailing the main legislation, the subjects of the institute, the beginning and causes of extinction and loss of the exercise of paternal power, and, finally, the effects on family relationships. In summary, it is intended to present the historical, legal and cultural context from the birth of the institute to the present day, highlighting the social and family consequences of the transformations of the family and the institute.
