Conforme o desenvolvimento tecnológico avança e nos brinda com maiores facilidades e mais
ofertas de bens e serviços, especialmente, no que tange ao setor bancário, o qual amplia sua
oferta de serviços por meios digitais cotidianamente, tendo diminuído em escala relevante a
prestação de serviço físico, surgem novos riscos e oportunidades para aqueles que se valem da
má-fé para ludibriar, enganar e usurpar o outro. Olhando sob esta ótica, os consumidores estão
cada vez mais expostos às fraudes por meio de engenharia social, phishing, malware, clonagens
bancárias, falsidade ideológica, entre outros. Tais formas de fraude são amplamente utilizadas
para coletar dados pessoais e bancários por meio da persuasão para enganar a vítima, com o
encaminhamento de mensagens de texto afim de induzir ou seduzir o consumidor a fornecer os
dados solicitados e/ou redirecionamento para sites falsos, compras inexistentes ou, ainda, para
as páginas falsas de instituições financeiras. Este estudo trata sobre os limites de aplicação da
responsabilidade civil dos bancos e dos consumidores, apresentando teorias aplicáveis ao
problema e procurando chegar a conclusão da mais adequada responsabilização das partes. O
procedimento adotado para sintetizar o conteúdo pesquisado foi realizado por meio de
pesquisas bibliográficas e análise de súmulas e jurisprudências.
As technological development advances and provides us with greater facilities and more offers of goods and services, especially with regard to the banking sector, which expands its offer of services by digital means on a daily basis, with a significant reduction in the provision of physical services, new risks and opportunities arise for those who use bad faith to deceive, cheat and usurp others. From this perspective, consumers are increasingly exposed to fraud through social engineering, phishing, malware, cloning, ideological falsehood, among others. These forms of fraud are widely used to collect personal and banking data through persuasion to deceive the victim, by forwarding text messages in order to induce or seduce the consumer into providing the requested data and/or redirecting them to fake websites, non-existent purchases or even to the fake pages of financial institutions. This study deals with the limits of the application of civil liability of banks and consumers, presenting theories applicable to the problem and trying to reach the conclusion of the most appropriate liability of the parties. The procedure adopted to synthesize the researched content was carried out through bibliographical research and analysis of precedents and case law.
