Resumo
A presente monografia propõe-se a discutir a possibilidade de implementação dos Princípios
do Contraditório e da Ampla Defesa em sede de inquérito policial, visando alcançar a paridade
de armas processual. Atualmente o tema divide opiniões na doutrina, desse modo a presente
obra busca ampliar o debate com enfoque nos direitos fundamentais previstos na Constituição
Federal de 1988, bem como a instrumentalidade do processo penal, de modo que arbitrariedades
sejam evitadas por intermédio das garantias processuais. Para realização da presente pesquisa
foi utilizado o método dedutivo que é uma abordagem lógica, que tem início em premissas
gerais para formação de conclusões especificas, desse modo o presente trabalho inicia
conceituando o inquérito policial, sua função, características e afins, passando para os sistemas
processuais penais onde busca justificar a implementação dos princípios para adequação do
sistema acusatório formal adotado pelo Brasil. Logo após é avaliado o conceito e valoração de
prova, buscando compreender os elementos produzidos em sede preliminar seguido pelos
princípios garantistas, bem como a importante função que desempenham no processo penal e,
por fim, a pesquisa debruça-se sobre a utilização da investigação defensiva como forma de
amenizar os desequilíbrios processuais causados pela ausência do Contraditório e da Ampla
Defesa na fase pré-processual.
This article aims to discuss the possibility of implementing the Principles of Adversarial Proceedings and Full Defense within police inquiries, aiming to achieve procedural parity. Currently, the topic divides opinions in legal doctrine, and this work seeks to broaden the debate, focusing on the fundamental rights provided in the 1988 Brazilian Federal Constitution, as well as the instrumentality of criminal procedure to prevent arbitrary actions through procedural guarantees. For the present research, the deductive method was used, which is a logical approach starting from general premises to form specific conclusions. Thus, this work begins by defining police inquiries, their function, characteristics, and related aspects, then moves on to the criminal procedural systems to justify the implementation of these principles to adapt to the formal accusatory system adopted by Brazil. Following this, the concept and valuation of evidence are evaluated to understand the elements produced in preliminary proceedings, followed by an examination of the guarantor principles and their important role in criminal procedure. Finally, the research focuses on the use of defensive investigation as a means to mitigate the procedural imbalances caused by the lack of adversarial proceedings and full defense in the pre-trial phase.
