O presente trabalho acadêmico possui como objetivo central analisar a viabilidade do reconhecimento de vínculo empregatício entre a empresa Uber do Brasil Tecnologia Ltda. e seus motoristas colaboradores. Com o surgimento e crescimento das plataformas digitais de transporte no Brasil e ao redor do mundo, surgiram questionamentos sobre a natureza jurídica dos contratos de trabalho realizados por esses profissionais, ou seja, se eles seriam considerados empregados ou trabalhadores autônomos. A tese busca entender os elementos subjetivos necessários para o reconhecimento do vínculo empregatício, como a pessoa física (o motorista deve ser pessoa natural), a habitualidade (períodos de atividade e inatividade do trabalho), a onerosidade (a remuneração recebida pelo serviço prestado), a pessoalidade (quando a prestação do serviço não pode ser delegada a outro sem autorização), e a subordinação (quando o trabalhador está sujeito ao controle do empregador). A partir desses elementos, será possível avaliar qual seria o enquadramento mais adequado para os motoristas colaboradores da Uber, de acordo com o ordenamento jurídico e a jurisprudência. Dada a relevância desse tema na atualidade, devido à complexidade de interpretação e aplicação da legislação trabalhista em relação a novos modelos de negócio que envolvem a intermediação de trabalho por plataformas digitais, serão estudadas decisões recentes sobre o reconhecimento, ou não, do vínculo empregatício. O foco principal será dado à análise do elemento da subordinação, que é geralmente o mais controverso nas discussões sobre o tema. Com base nessas análises, espera-se contribuir para o debate sobre a viabilidade do reconhecimento de vínculo empregatício entre a Uber e seus motoristas colaboradores. Dessa forma, será possível entender melhor as repercussões jurídicas e sociais envolvidas nesse novo tipo de relação de trabalho e, possivelmente, auxiliar na construção de soluções que protejam os direitos dos trabalhadores sem prejudicar o desenvolvimento dessas novas formas de negócio.
The main objective of this academic work is to analyze the feasibility of recognizing employment relationship between Uber do Brasil Tecnologia Ltda. and its driver partners. With the emergence and growth of digital transportation platforms in Brazil and around the world, questions have arisen regarding the legal nature of the employment contracts of these professionals, specifically whether they should be considered employees or independent contractors. The thesis seeks to understand the subjective elements necessary for the recognition of an employment relationship, such as the individual (the driver must be a natural person), regularity (periods of work and inactivity), remuneration (the compensation received for the service rendered), personal service (when the provision of the service cannot be delegated to another without authorization), and subordination (when the worker is subject to the control of the employer). Based on these elements, it will be possible to evaluate the most appropriate classification for Uber's driver partners, in accordance with the legal framework and jurisprudence. Given the relevance of this topic in contemporary times, due to the complexity of interpreting and applying labor legislation in relation to new business models that involve labor intermediation through digital platforms, recent decisions regarding the recognition, or lack thereof, of an employment relationship will be studied. The main focus will be on analyzing the element of subordination, which is usually the most contentious in discussions on this topic. Based on these analyses, it is hoped to contribute to the debate on the feasibility of recognizing an employment relationship between Uber and its driver partners. In this way, it will be possible to better understand the legal and social implications involved in this new type of employment relationship and potentially assist in developing solutions that protect the rights of workers without impeding the development of these new business forms.
