O presente artigo científico visa discorrer sobre os impactos das pirâmides financeiras e do marketing multinível na sociedade atual, considerando que o marketing multinível é uma prática legal e a pirâmide financeira uma prática ilícita. Para isso, serão abordadas as semelhanças e as diferenças destes dois modelos de negócio, evidenciando como as legislações brasileiras são aplicadas nos casos concretos. A análise será realizada de forma comparativa, tendo um grande foco no Direito Penal. Além disso, o estudo trará as vantagens e as desvantagens que as pirâmides financeiras e o marketing multinível acarretaram ao mercado brasileiro e uma análise aprofundada das consequências para os participantes dos esquemas fraudulentos.
This scientific article aims to discuss the impacts of financial pyramids and multilevel marketing on today's society, considering that multilevel marketing is a legal practice and financial pyramids an illegal practice. To this end, the similarities and differences between these two business models will be addressed, highlighting how Brazilian legislation is applied in specific cases. The analysis will be carried out in a comparative manner, with a strong focus on criminal law. In addition, the study will look at the advantages and disadvantages that financial pyramids and multilevel marketing have brought to the Brazilian market and an in-depth analysis of the consequences for participants in fraudulent schemes.
