Abstract
O objetivo deste artigo científico é expor como o conteúdo artístico dos jogos eletrônicos impactam o cotidiano, o mercado e, consequentemente, o ordenamento jurídico. A reprodução desse conteúdo pode propiciar discussões sobre a sua Propriedade Intelectual e, mais especificamente, sobre o direito autoral, seja na utilização subjetiva ou no âmbito concorrencial de mercado. A metodologia utilizada foi a análise de possíveis ou concretos casos de uso e reprodução da obra intelectual artística. Após análise da Lei de Direitos Autorais – Lei nº 9.610/98, foi possível concluir que a aplicação harmônica de institutos internacionais, como a Convenção de Berna de 1886 e o Acordo ADPIC/TRIPS da OMC, faz-se extremamente necessária para garantir a justa limitação dos direitos do autor.
This scientific article has the objective to expose how the artistic content in electronic games has an impact on daily life, on the market and, consequently, in legal system. The reproduction of this content can provide discussions about Intellectual Property and more specifically about copyright, be it in subjectively use or in the competitive market. The methodology used was the analysis of possible or concrete cases of the use and reproduction of intellectual artistic work. After the analysis of the Brazilian Copyrights Law – Law No. 9.610/98, it was possible to conclude that the harmonic application of international institutes, like Berne Convention in 1886 and ADPIC/TRIPS Agreement of OMC, make it extremely necessary to guarantee a fair limitation of the author rights.
