O reconhecimento de pessoas trata-se de um meio de prova presente no processo penal
brasileiro que possui como principal finalidade identificar a autoria delitiva de um crime. Visto
que comumente utilizado, fato é que tal procedimento, descrito no art. 226 do Código de
Processo Penal, deve ser observado com bastante cautela, uma vez que depende diretamente da
memória humana e esta é constantemente afetada pelas chamadas “falsas memórias”, não
possuindo, portanto, uma certeza concreta. Sobre esse ponto, a doutrina majoritária destaca que
o reconhecimento de pessoas deve ser visto apenas como uma mera recomendação. É a partir
de tais premissas que o objetivo deste trabalho será realizar uma apresentação do conceito,
espécies, formalidades e consequências no âmbito do reconhecimento de pessoas, além de
elaborar uma análise crítica acerca da não observância das formalidades legais e as
consequências de tais infrações. Por fim, com o intuito de aprofundar o tema e exemplificá-lo,
serão abordados casos concretos de indivíduos inocentes que foram condenados injustamente
com base apenas no reconhecimento de pessoas, tendo, posteriormente, suas condenações
revertidas pela organização The Innocence Project.
The recognition of people is a means of proof present in the Brazilian criminal procedure that has as its main identification the criminal authorship of a crime. Although commonly used, the fact is that such a procedure, described in art. 226 of the Code of Criminal Procedure, must be observed with great caution, since it depends directly on human memory and this is constantly awaited by the so-called “false memories”, therefore not having a concrete certainty. On this point, the majority doctrine emphasizes that the recognition of people should be seen only as a mere recommendation. It is based on these assumptions that the objective of this work will be to present the concept, types, formalities and consequences in the context of recognizing people, in addition to preparing a critical analysis of non-compliance with legal formalities and the consequences of such infractions. Finally, in order to deepen the theme and exemplify it, concrete cases of innocent individuals who were wrongfully convicted based only on the recognition of people will be shown, having, later, their convictions reversed by the organization The Innocence Project.
