Judicialização da saúde e o acesso a medicamentos para pessoas hipossuficientes: análise de jurisprudências nos tribunais e possíveis mecanismos de solução de controvérsias

O presente trabalho visa apresentar a dificuldade das pessoas consideradas hipossuficientes financeiramente frente ao acesso a medicamentos no Brasil, sendo então provisionados pelo Sistema Único de Saúde, discussão que gera uma grande procura ao Poder Judiciário para pleito de direitos, constitucionalmente previstos, como o direito social e fundamental à saúde, apresentados no artigo 6° e 196 e seguintes da Constituição da República Federativa do Brasil de 1988. Deste modo, cresce o fenômeno chamado “Judicialização da Saúde” no Brasil, tendo em vista o alto número de processo judiciais envolvendo o direito à saúde, e, principalmente, o fornecimento de medicamentos, conforme relatórios e resoluções do Conselho Nacional de Justiça, os quais são objetos de análise deste trabalho, bem como a análise das decisões jurisprudenciais no Supremo Tribunal Federal e do Superior Tribunal de Justiça em temas ligados ao fornecimento de medicamentos e, consequentemente, definidos nos Temas 6 e 106 do Supremo Tribunal Federal e Superior Tribunal de Justiça, respectivamente. Utilizou-se, por conseguinte, a metodologia de pesquisa qualitativa, por meio de pesquisa bibliográficas de periódicos, resoluções, jurisprudência avaliando a realidade no Brasil, e entre outros. Por fim, o trabalho certifica-se que a judicialização pode ser amenizada com a ajuda de outros meios de soluções de controvérsias, conhecidos pela mediação e conciliação, buscando-se possíveis soluções para tal problema crônico na sociedade brasileira, perante a análise da Resolução n° 125 de 2010 do Conselho Nacional de Justiça e as consequências práticas para a autocomposição processual para uma melhora no atendimento e solução efetiva frente à Judicialização da Saúde.
The present study aims to demonstrate the difficulties that the under-sufficient financially people have on the access to health care and specially medicines in Brazil, by the public system (Single Health System (SUS)), discussion that generates a huge demand for the Brazilian judiciary with legal disputes for rights expressly provided in the Constitution, like the social and fundamental right to health, presented in the articles 6° and 196 and following articles of the Constitution of the Federative Republic of Brazil of 1988. Therefore, it begings to grow the phenomenon called Judicialization of health in Brazil, in view of the high number of judicial proceedings involving the right of health, mainly, the supply of drugs, according to reports and resolutions of National Council of Justice, that are subjects of analysis in this study, as well the analysis of the decisions in the Federal Supreme Court and Superior Court of Justice with topics related to access to medicines, which consequently were defined in the Topics 6 and 106 of Federal Supreme Court and Superior Court of Justice, respectively. Were used, therefore, the qualitative research methodology, based the research of periodicals, resolutions, reports, jurisprudence researching the reality in Brazil, among others. Finally, the study certify that the judicialization can be mitigated with the mediation and conciliation searching potential solutions for this chronic problem in the Brazilian society, based in the Resolution n° 125/2010 of the National Council of Justice and practical implications for a better solution for the Judicialization of health.
