Resumo
Esse trabalho tem por finalidade fazer uma análise sobre o sandbox regulatório e as mudanças e impactos que ele trouxe para as Startups.
Nos dias de hoje é muito comum entrarmos na internet e nos deparamos com um mundo direcionado ao consumo, com a tecnologia nossa forma de consumir evoluiu e não é mais necessário irmos a um lugar físico para comprar. Essa nova forma de consumir fez surgir inúmeras empresas que possuem em seu pilar a inovação e tecnologia, e a elas damos o nome de Startups. Com essas empresas sendo criada aos montes, nasce no Estado a necessidade de regular, uma vez que essas startups atuam nos mais variados setores, desde a saúde até o transporte particular de pessoas, a regulação é uma forma de incentivar e fazer com que haja uma progressão dessas empresas emergentes, pois elas impactam positivamente a economia do país.
Nos anos 2000, essas empresas de viés tecnológico e inovativo chegam no Brasil, mas enfrentam grande burocratização, não havendo incentivo ou fomento para que elas se desenvolvam, é então que diante de um cenário pandêmico é criado o marco legal das Startups2. O sandbox regulatório, é uma figura criada por esta lei, é um ambiente controlado experimental vigiado pelos órgãos reguladores estatais, ele atua com um período certo, ou seja, não pode existir para sempre, e nesse período ocorrem testes quanto a viabilidade do produto, da tecnologia e do serviço da empresa emergente, submetidos a uma regulação mais versátil, fluída com a possibilidade de se observar os avanços tecnológicos previamente à sua disposição no mercado comercial.
O trabalho analisa que o sandbox regulatório permite que haja um ambiente de teste com risco controlado, fazendo com que tenha um grande avanço na inovação nas startups e uma aliança entre setor público e privado, com os órgãos reguladores e as empresas emergentes. Verificou-se através de levantamento bibliográfico que o sandbox regulatório pode ser utilizado nos mais variados modelos de startups, fazendo com que múltiplas empresas emergentes possam testar sua inovação usufruindo desse meio, desde empresas voltadas a saúde como a Healthcare “alice” ou ao transporte privado como a Uber.
This work aims to make an analysis about the regulatory sandbox and the changes and impacts it brought to startups. Nowadays it is very common to enter the internet and come to a world directed to consumption, with technology our way of consuming has evolved and it is no longer necessary to go to a physical place to buy. This new way of consuming has given rise to numerous companies that have in their pillar innovation and technology, and these companies give the name of Starups.Com these companies being created in droves, the need to regulate is born from the State, since these starups operate in various sectors, from health to the private transportation of people, in order to encourage and cause a progression of these emerging companies, as they positively impact the economy of this State. In the 2000s, these companies of technological and innovative bias arrived in Brazil, but face great bureaucratization without incentive for emerging companies, it is then that in the face of a pandemic scenario is created the legal framework of Startups. The regulatory sandbox, is a figure created by this law, it is an experimental controlled environment monitored by state regulatory agencies, it acts with a stipulated validity, can not exist forever, and in this period occur test as to the viability of the product, technology and service, subjected to a more versatile regulation, fluid with the possibility of observing technological advances previously available to its disposal in the commercial market. The paper analyzes that the regulatory sandbox allows for a risk-controlled testing environment, making it a major breakthrough in startup innovation and an alliance between the public and private sectors, with regulators and emerging companies. It was verified through a bibliographic survey that the regulatory sandbox can be used in the most varied models of startups, making multiple emerging companies can test their innovation by enjoying this medium, from health-focused companies such as Healthcare "alice" to the integrated system of Uber vs. Public Sector.
