Resumo
O presente trabalho busca analisar a formação de regulamentos relacionados ao sistema de pagamentos brasileiro, analisando a eventual validade jurídica das regulamentações estabelecidas pelo Conselho Monetário Nacional (“CMN”) e publicadas e fiscalizadas, dentre outras funções, pelo Banco Central do Brasil (“BCB”), com foco nas regras do Sistema de Pagamentos Brasileiros, sob a ótica da Constituição Federal da República Federativa do Brasil (“CF”), a qual determina que o Sistema Financeiro Nacional (“SFN”) será regulado através de lei complementar.
Para tanto, será analisada a formação e conceitos das normas brasileiras, o Sistema Financeiro Nacional, o Banco Central do Brasil, a regulamentação do Sistema de Pagamentos Brasileiro e suas espécies, com foco nas startups, em especial as fintechs.
A partir desses esclarecimentos, será averiguado a aplicação dessas definições para o mercado financeiro brasileiro.
This essay addresses on the analysis of the formation and (in)validity of the regulations established by the National Monetary Council ("CMN") and published by the Central Bank of Brazil ("BCB"), focusing on the rules of the Brazilian Payments System, under the perspective of the Federal Constitution of the Federative Republic of Brazil (“CF”), which determines that the National Financial System (“SFN”) will be regulated through a supplementary law.
