O presente artigo possui como objetivo central aplicar os fundamentos da teoria do
Labellig Approuch ao sistema carcerário brasileiro.
À priori, serão abordados os conceitos e fundamentos da teoria e as formas de
criminalização, que doutrinariamente se dividem como primária e secundária; as instâncias
de controle, formais e informais e a maneira pela qual exercem seu papel dentro do sistema.
Posteriormente, será analisada a forma pela qual é realizada a estigmatização do
indivíduo, trazendo um panorama atual do sistema carcerário brasileiro, com base em dados
estatísticos recentes de pesquisas relacionadas ao sistema carcerário (INFOPEN – 2017) e
relatório de reincidência criminal (IPEA – 2015).
Por fim, serão abordados os principais pontos e aplicação da teoria, com um olhar
crítico, provocando a busca pela implementação de alternativas diferentes que senão “punir”
e “encarcerar”, uma vez que tais medidas, da maneira que tem sido executadas, têm se
mostrado insuficientes para sanar o crescente problema de criminalidade que assola nosso
país.
This article has as its main objective to apply the fundamentals of the theory of Labellig Approach to the Brazilian prison system. At first the concepts and foundations of the theory and forms of criminalization will be addressed, which doctrinally are divided as primary and secondary. The instances of control formal & informal and the way in which they exercise their role within the system. Subsequently, it will be analyzed how the stigmatization of the individual is carried out, bringing a current overview of the Brazilian prison system, based on recent statistical research data related to the prison system (INFOPEN - 2017) and criminal receive report (IPEA- 2015). Finally, the main points and application of the theory will be addressed with a critical eye, causing the search for the implementation of different alternatives other than "punish" and "incarcerate", since such measures the way they have been implemented have proven insufficient to solve the growing problem of crime that plagues our country.
