O presente trabalho trata do Direito Sistêmico no âmbito dos conflitos familiares, assunto polêmico e inovador que está sendo utilizado como método alternativo de resolução de litígios jurídicos. A pesquisa contextualiza o Direito Sistêmico, expondo sua fundamentação, qual seja, a teoria das Constelações Familiares. Outrossim, o artigo conta a história do desenvolvedor da terapia, Bert Hellinger, discorrendo sobre seus estudos e a criação das Leis Sistêmicas. É então abordado o problema que enfrenta o Judiciário, com o grande número de demandas pendentes de julgamento, o que deu espaço às formas de autocomposição de litígios, que foram internalizadas pela Lei nº 13.140/2015 e pelo Código de Processo Civil de 2015. Dessa forma, é contextualizado a oportunidade em que surgiu o Direito Sistêmico bem como seus resultados, como método alternativo de resolução de conflitos, sob a ótica do trabalho desenvolvido pelo juiz Sami Storch. Por fim, são expostas às críticas relativas à teoria, considerando que a temática está atualmente em discussão no Senado.
This paper deals with Systemic Law in the context of family conflicts, a controversial and innovative subject that is being used as an alternative method of resolving legal disputes. The research contextualizes the Systemic Law, exposing its foundation, which is the theory of Family Constellations. Furthermore, the article tells the story of the developer of the therapy, Bert Hellinger, talking about his studies and the creation of the Systemic Laws. The problem faced by the Judiciary is then addressed, with the large number of lawsuits pending trial, which gave way to forms of self-composition of disputes, which were internalized by Law No. 13,140/2015 and the Civil Procedure Code of 2015. Thus, it is contextualized the opportunity in which Systemic Law emerged as well as its results, as an alternative method of conflict resolution, from the perspective of the work developed by Judge Sami Storch. Finally, the criticisms regarding the theory are exposed, considering that the theme is currently under discussion in the Senate.
