A Constituição de 1988 garante o direito à educação para todos os brasileiros. Para garantir esse direito constitucional foram criados, desde a redemocratização, inúmeros mecanismos para reformar a educação brasileira a fim de incluir grupos que, por sua condição social, econômica ou identitária, foram tolhidos desse direito. A população LGBTQIA+ é um desses grupos minorizados. Sua relação com as instituições de ensino é marcada por abusos físicos e psicológicos, como mostra a "Pesquisa Nacional Sobre o Ambiente Educacional no Brasil" realizada pela Secretaria de Educação da Associação Brasileira de Lésbicas, Gays, Bissexuais, Travestis e Transexuais. A instituição escola, nesse contexto, se configura como um agente importante na exclusão dessas identidades, uma vez que sua atuação tem contribuído para a discriminação sofrida pelos alunos LGBTQIA+. Somado a isso, as políticas que visam alterar esse papel excludente da escola, sofrem constantemente a pressão de grupos conservadores da sociedade, e não conseguem avançar, ocasionando na persistência dessa exclusão.
The Constitution of 1988 guarantees the right to education for all Brazilian citizens. In order to guarantee this constitutional right, it was created, after the redemocratization, countless mechanisms to amend the Brazilian education in order to include groups that, for its social, economic or identity condition, had this right deprived. The LGBTQIA+ population is one of this minorized groups. It's relation with the educational institutions is marked by physical and psychological abuse, as shows the "National Research about the Educational Environment in Brazil" made by the Secretary of Education of the Brazilian Lesbian, Gay, Bisexual, Trans and Travesti Association. The School Institution, in this context, figures as an importante agent in the exclusion of these identities, since its acting has contributed to the discrimination suffered by the LGBTQIA+ students. Furthermore, the policies that aim to change this exclusionary role of the school constantly suffer the pressure of conservative groups of society, and do not get to progress, causing the endurance of this exclusion.
