Resumo
O presente artigo tem como objetivo analisar o instituto da convenção processual e
verificar a sua aplicabilidade no processo em fase executiva como instrumento para promover
a celeridade e efetividade da tutela jurisdicional. Assim, primeiramente, serão examinadas as
origens do instituto, além de seu contexto de introdução no ordenamento jurídico brasileiro.
Ademais, será examinado o conceito, as classificações e os requisitos das convenções
processuais, bem como os seus limites, e sua aplicabilidade perante os tribunais pátrios. Por
fim, observará os aspectos de tal instituto quando aplicado ao processo de execução. Tais
convenções processuais entabuladas em sede de execução ratificam o modelo cooperativo de
processo, bem como os princípios de economia processual e efetividade da tutela jurisdicional.
Ao final do exposto, é possível concluir que, apesar do curto espaço de tempo desde o início de
sua vigência, a aplicação do art.190 CPC/2015 tem demostrado seu potencial, fomentando
discussões nos tribunais pátrios e doutrinária, além de ser uma importante ferramenta para
consagrar a celeridade e efetividade da tutela jurisdicional.
This article aims to analyze the institute of procedural convention and verify its applicability in the process in the executive phase as an instrument to promote the speed and effectiveness of judicial protection. Thus, first, the origins of the institute will be examined, in addition to its context of introduction into the Brazilian legal system. In addition, the concept, classifications and requirements of the procedural convention, as well as its limits, and their applicability before the national courts will be examined. Finally, it will observe the aspects of such an institute when applied to the execution process. Such procedural conventions signed at the point of execution ratify the cooperative process model, as well as the principles of procedural economics and effectiveness of jurisdictional protection. At the end of the foregoing, it is possible to conclude that, despite the short time since the beginning of its validity, the application of art.190 CPC / 2015 has demonstrated its potential, fostering discussions in the national and doctrinal courts, in addition to being an important tool to establish the speed and effectiveness of jurisdictional protection.
