Princípio da força obrigatória dos contratos e lei 10.209/2001: análise do impacto da legislação que obriga o pagamento antecipado do vale pedágio na relação contratual

A Lei 10.209/2001 que entrou em vigor em 25 de outubro de 2002, instituiu o pagamento antecipado obrigatório via formulário próprio do Vale-Pedágio, sobre o transporte rodoviário de carga. Tal medida não observou os diversos aspectos da malha rodoviária Brasileira, assim como as peculiaridades da relação contratual existente entre embarcador e transportador autônomo ou transportadoras. Diante do contexto firmado pela vigência da Lei 10.209/2001 e da dificuldade da aplicabilidade efetiva de tal norma, faz-se necessário discutir formas de garantir a efetividade da norma posta, assim como observar o princípio da força obrigatória dos contratos, princípio este que aliado ao princípio da boa-fé objetiva e função social dos contratos norteiam a relação contratual, possibilitando que as Partes possam prever as cláusulas contratuais mais convenientes para a prestação do serviço e de acordo com a função social do contrato. Este trabalho tem por objetivo apresentar e analisar, sob à luz dos princípios da força obrigatória dos contratos, da boa-fé e da função social dos contratos a Lei 10.209/2001 que regulamenta o pagamento obrigatório antecipado do vale pedágio ao transportador. Será apresentado os conceitos dos princípios relacionados acima, assim como os conceitos e atribuições do embarcador estabelecidos na legislação vigente sobre o tema, para embasar a discussão proposta neste trabalho. O presente estudo será feito por meio do método dedutivo, com fundamento na legislação vigente, apontando as dificuldades no cumprimento da legislação, demonstrado como a inflexibilidade da referida lei impacta a relação contratual estabelecida entre as Partes.
Law 10.209/2001, which entered into force on October 25, 2002, established the mandatory advance payment via the Toll Voucher’s own form, on road freight transport. This measure did not observe the various aspects of the Brazilian road network, as well as the peculiarities of the contractual relationship between shipper and autonomous carrier or carriers. Given the context established by the validity of Law 10.209/2001 and the difficulty of the effective applicability of such standard, it is necessary to discuss ways to ensure the effectiveness of the standard, as well as observe the principle of mandatory force of contracts, principle that allied to the principle of objective good faith and social function of contracts guide the contractual relationship, allowing the Parties to provide the most convenient contractual clauses for the provision of service and according to the social function of the contract. This paper aims to present and analyze, in the light of the principles of mandatory strength of contracts, good faith and the social function of contracts the Law 10.209/2001 that regulates the mandatory payment of the toll voucher to the carrier. It will be presented the concepts of the principles listed above, as well as the concepts and duties of the shipper established in the current legislation on the subject, to support the discussion proposed in this paper. The present study will be done through the deductive method, based on the current legislation, pointing out the difficulties in complying with the legislation, demonstrated how the inflexibility of said law impacts the contractual relationship established between the Parties.
