Abstract
O presente artigo tem como enfoque a análise das dificuldades enfrentadas pelos agentes de
tratamento de dados pessoais que têm como principal atividade a prestação de serviços e
produtos que utilizem métodos de IoT “Internet of Things” e devem, ao mesmo tempo, estar
em conformidade com a Lei nº 13.709/18 (Lei Geral de Proteção de Dados “LGPD”), recém
sancionada no Brasil. O objetivo geral é compreender os impactos jurídicos e de privacidade
na comercialização de produtos que contenham a tecnologia de internet das coisas, podendo
consequentemente gerar riscos aos direitos individuais fundamentais dos titulares de dados
pessoais, entre eles a intimidade e vida privada. Compreendendo as premissas devidas à análise
dos fatos, foi possível partir para análise de casos práticos para aplicação das legislações e
regulamentações concernentes ao tema. Para elucidação final dos fatos e entendimentos
conclusivos, foi necessário analisar a fundo a legislação nacional, doutrinas, boas práticas
internacionais e estudos de casos referentes ao tema, bem como de sansões aplicadas a eventuais
infrações.
he present article focuses on the analysis of the difficulties faced by personal data processing agents whose main activity is the provision of services and products that use IoT methods “Internet of Things” and must, at the same time, be in compliance with Law No. 13.709/18 (General Data Protection Law “LGPD”), recently sanctioned in Brazil. The general objective is to understand the legal and privacy impacts on the commercialization of products that contain the Internet of Things technology, which can consequently generate risks to the fundamental individual rights of the personal data subjects, including the right of intimacy and privacy. Understanding the premises due to the analysis of the facts, it was be possible to start analyzing practical cases for the application of laws and regulations concerning the theme. For the final clarification of the facts and conclusive understandings, it was necessary to thoroughly analyze the national legislation, doctrines, good international practices and case studies related to the theme, as well as sanctions applied to possible violations.
