Impactos da pandemia Covid-19 no cumprimento do plano de recuperação judicial de empresas em crise - análise de medidas emergenciais adotadas pelo Tribunal de Justiça do estado de São Paulo e projetos de lei propostos no Brasil

O presente trabalho busca, por meio de uma breve análise histórica, conceitual, processual e jurisprudencial, explorar as medidas adotadas pelo Poder Judiciário Brasileiro e, principalmente, do Tribunal de Justiça do Estado de São Paulo, para mitigar os impactos econômicos decorrentes da pandemia causada pelo sírus SARS-CoV-2, iniciada em março de 2020, e que afetou todas as camadas da cadeia de capital de giro ao redor do mundo. Desta forma, serão analisadas, em conjunto à Lei 11.101/2005, Lei de Recuperação Judicial e Falências, a jurisprudência adotada pelos magistrados do Tribunal de Justiça do Estado de São Paulo acerca dos temas que possibilitariam a empresa recuperanda a prevenir a convolação de seu processo de recuperação judicial em falência, projetos de Lei apresentados na Câmara dos Deputados e no Senado Federal que facilitariam a reestruturação das dívidas e balanço financeiro das sociedades empresarias e as novidades que acompanham a publicação da Lei 14.112/2020, a Nova Lei de Recuperação Judicial e Falências, que incorporou diversos dispositivos à Lei anterior, em decorrência da necessidade de atualização do processo recuperacional em face à situação imprevisível que se instaurou no mundo com o avanço da pandemia COVID-19.
This paper aims to analyze, trough a brief historical, conceptual, procedural and jurisprudential analysis, to explore the measures adopted by the Brazilian Judiciary Branch and, mainly, by the São Paulo State Court of Justice, to mitigate the impacts resulting from pandemic caused by the SARS-CoV-2 virus, launched in March 2020, and which affected all layers of the working capital chain around the world. Through this idea, along with Law 11.101/2005, Law of Judicial Recovery and Bankruptcy, the jurisprudence adopted by the judges of the São Paulo State Court of Justice on the issues that the company would enable to recover and prevent the convolution of its judicial reorganization process into bankruptcy, bills arising from the Chamber of Deputies and the Federal Senate that would facilitate the area of debts and financial balance of business companies and the novelties that accompany the publication of Law 14,112/2020, the New Judicial Recovery Law and Bankruptcies, which incorporated several provisions into the previous Law, due to the need to update the recovery process in view of the unpredictable situation that was established in the world with the progress of the COVID-19 pandemic.
