Resumo
O presente artigo busca analisar o direito real de laje sob a ótica constitucional, como direito de propriedade que surgiu para auxiliar o Estado a cumprir sua função social quanto ao direito de acesso à moradia digna, garantindo através de suas diretrizes a promoção da dignidade da pessoa humana e seu bem-estar social, gozando de segurança jurídica em relação à propriedade dos imóveis em áreas de risco bem como de ocupação irregular. Ao final analisa sob o aspecto legal a eficácia da lei 13.465/17, sua efetividade, tendo ela surgido com a finalidade de propiciar ao morador irregular a titulação do bem, ou seja, tornar legalmente legítima propriedade do bem, inclusive com matrícula individual, a través da cessão da laje, como unidade autônoma, facultando a este gozar, usar e dispor do bem, cumprindo portando todas as características de propriedade inclusive oferecê-lo como garantia real. Ao final explanaremos sobre eficácia deste direito à realidade fática bem como se este cumpre o dever do direito de aproximar aos problemas da sociedade que lhe rodeia.
In the last decades, the national housing scenario has undergone major changes, one of which was the massive staggering of the urban population in large centers, coming from the interiors and even from other States, increasing the demographic growth of the capitals and with that, a cascade effect emerged. the problem of the lack of accessible housing for the large number of migrants, who subsequently, faced with the impossibility of bearing the costs of the central cities, this mass went to the extremes of the city, starting to live in a precarious manner. Therefore, in order to remedy this issue, the right of slab arises through law 13465/2017, which together with other normative institutes tries to remedy the problems of lack of adequate housing. This article seeks to analyze the real slab right from a constitutional perspective, as a property right that emerged to assist the State in fulfilling its social function regarding the right of access to decent housing, guaranteeing through its guidelines the promotion of the dignity of the person and its social well-being, enjoying legal certainty in relation to property ownership in areas at risk as well as irregular occupation. At the end, it analyzes, under the legal aspect, the efficacy of Law 13.465 / 17, its effectiveness, having arisen with the purpose of providing the titleholder of the property with the irregular resident, that is, making the property legally legitimate, including with individual registration. , through the assignment of the slab, as an autonomous unit, allowing it to enjoy, use and dispose of the good, fulfilling all the characteristics of property including offering it as collateral. At the end, we will explain about the effectiveness of this right to the factual reality as well as if it fulfills the duty of the right to approach the problems of the society that surrounds it.favelas and irregular housing in large national urban centers, and the lack of housing due to high population growth, mainly in the peripheral areas, which caused a high housing deficit in large cities. At the end, it will conclude, based on the statement of facts, whether this new type of real property right will be effective.
