O presente trabalho buscou analisar a inadmissibilidade da prova ilícita no processo penal e, principalmente, hipóteses nas quais a ilicitude é afastada, sendo a prova admitida. Para tanto, abordou-se, inicialmente, o conceito de prova e sua função no processo, concluindo-se que a prova é o meio pelo qual leva-se ao magistrado a reconstrução dos fatos, através das quais este formará sua convicção. Em seguida, foram apresentadas as razões de determinadas provas serem consideradas ilegais, explicando a diferença entre provas ilícitas e provas ilegítimas. Demonstrou-se também que, em que pese a vedação expressa das provas ilícitas, essa inadmissibilidade não é absoluta. Dessa forma, analisou-se algumas das hipóteses em que o legislador admitiu a utilização da prova ilícita quando obtidas através de fonte independente ou quando sua descoberta seria inevitável. Analisou-se, ainda as hipóteses de admissibilidade da prova ilícita pro reo e a partir do princípio da proporcionalidade. Por fim, concluiu-se que as provas ilícitas devem ser utilizadas sempre que embasarem a absolvição do acusado.
The current work has analysed the inadmissibility of illicit proof in criminal proceeding and mostly hypothesis in which the illegality is set aside, this way admitting the proof. For that, first it has approached the concept of proof and its function in the process, concluding that the proof is the means which provides the magistrate´s facts reconstruction and because of that the judge may form the conviction. Afterward, it was presented several reasons of determinated proofs are considered ilegal, explaining the difference between illicit proofs and unlawful ones. It was also demonstrated that the explicit prohibition of illicit proofs this inadmissibility is not absolute. That way, it was analysed some hypothesis in which the legislative authority admitted the illicit proof utilization when it was achieved throughout independent source or when its discovery would be unavoidable. It was also analysed the hypothesis of inadimissibiliy of illicit proof pro reo and as of proportionality principle. Therefore, it was concluded that illicit proofs should be always considered to substantiate the acquittal of a defendant.
