O presente trabalho analisou a utilização de jurisprudências defensivas pelo Superior Tribunal de Justiça como forma de diminuir a quantidade de recursos dirigidos à Corte Superior.
Inicialmente, buscou-se demonstrar a situação atual do STJ, que inegavelmente possui demanda enorme e que aumenta cada vez mais a cada ano que passa. Ato contínuo, o estudo toma como base os princípios do acesso à justiça e celeridade processual, analisando essas duas garantias constitucionais e processuais.
A partir deste conjunto de temas, são expostos os principais efeitos da utilização de jurisprudências defensivas e suas implicações nos princípios supracitados. Ao final, conclui-se que as jurisprudências defensivas em nada resolvem o excesso de recursos dirigidos ao Superior Tribunal de Justiça, frustrando o acesso à justiça e tornando os processos ainda mais lentos.
This essay aims at analyzing the use of defensive jurisprudence by the Superior Court of Justice to reduce the amount of appeals to the Superior Court. Initially, we tried to demonstrate the current situation of the STJ, which undeniably has huge demand, and which increases more and more every year. The study is based on the principles of access to justice and procedural promptness, analyzing these two constitutional and procedural guarantees. From this set of themes, the main effects of the use of defensive jurisprudence and its implications on the above-mentioned principles are exposed. Finally, it is concluded that defensive jurisprudence does not solve the excess of appeals to the Superior Court of Justice, frustrating access to justice and slowing down processes.
