O redfern schedule sob a perspectiva das common e civil law: em busca da padronização da arbitragem internacional

Esta pesquisa analisará o instrumento do Redfern Schedule, utilizado nas arbitragens
internacionais, com o objetivo de identificar se este instrumento estabelece uma ponte entre os
sistemas de common e civil law. Além disso, serão verificadas questões subsidiárias desse
instrumento quanto ao tempo e custo na produção de provas, ao eventual abuso de poder das
partes, à gestão dos documentos produzidos e aos critérios de materialidade e relevância das
provas requeridas. A partir disso, foram consultadas a legislação brasileira e norte-americana,
doutrina nacional e internacional, jurisprudência comentada, os regulamentos das instituições
arbitrais e, em especial, as fontes de soft law da arbitragem, como as diretrizes, resoluções,
regras, protocolos, práticas, reportes e costumes. Ao final, conclui-se que o Redfern Schedule
nunca objetivou estabelecer uma ponte entre os sistemas de common e civil law, pois consiste
simplesmente numa tabela com quatro colunas, que servem para a organização dos pedidos de
produção de documentos entre as partes, que pode ser utilizado em qualquer procedimento, seja
judicial ou arbitral, brasileiro ou americano. Destaca-se ainda que a escolha e aplicação desse
instrumento na arbitragem internacional poderá prejudicar as partes envolvidas se fizerem o uso
incorreto e inadequado, gerando tempo e custo excessivo ao procedimento, abuso de poder entre
elas e má gestão de documentos produzidos. Diante disso, sugere-se o acréscimo de mais uma
coluna ao Redfern Schedule à parte solicitada, como parte das objeções, para informar o custo
e o tempo para produção do documento solicitado.
This research will analyze the Redfern Schedule instrument, used in international arbitrations, to identify if it establishes a bridge between the common and civil law systems. In addition, the subsidiary questions will be verified regarding time and cost of the production of evidence, possible abuse of power of the parties, management of the documents produced and requirements of materiality and relevance for requesting evidence. Based on that, it will consulted the Brazilian and American legislation, national and international doctrine, commented jurisprudence, institutions rules of arbitration and, in particular, the soft law instruments of arbitration, such as guidelines, resolutions, rules, protocols, practices, reports and customs. In the end, it concludes that the Redfern Schedule never aimed to establish a bridge between the common and civil law systems, as it consists simply on a four-column table, which serves for organizing and requesting the production of documents between the parties, which could be used in any procedure, whether judicial or arbitral, Brazilian or American. It is also noteworthy that its choice and application in international arbitration may damage the parties involved by incorrect and inappropriate use, causing excessive time and cost to the procedure, abuse of power between them and mismanagement of documents produced. In view of this, it suggests the addition of one extra column to the Redfern Schedule to the requested party, as part of the objections, to inform the time and cost to produce the requested documents.
