O presente trabalho tem por objetivo analisar e discutir a parentalidade após o divórcio
e de que forma a separação pode repercutir na relação dos pais com os filhos e na
construção do seu saudável desenvolvimento, bem como o papel do Judiciário na
prevenção e resolução dessas situações, em atendimento aos princípios, deveres e
direitos previstos na Constituição Federal, no Estatuto da Criança e do Adolescente e
no Código Civil. Em ordem cronológica de acontecimentos, buscou-se estudar o
desenvolvimento da relação conjugal, a formação do poder familiar, a separação do
casal com filho menor e a interferência dos sentimentos e do modelo parental
histórico-social nas relações familiares, que podem ocasionar a chegada da família no
tribunal para solução dos conflitos e o papel do Judiciário nos assuntos que envolvem
o Direito de Família com foco na criança e no adolescente. Por fim, buscou-se
entender e estudar, acima de tudo, os deveres intrínsecos ao poder familiar que não
se extinguem com a separação do casal. A metodologia utilizada para a elaboração
deste estudo foi a revisão bibliográfica multidisciplinar e doutrinária, com foco na
Psicologia e no Direito, e a pesquisa de jurisprudência para verificar o atual
entendimento dos tribunais sobre o assunto. Verificou-se que a fronteira entre
conjugalidade e parentalidade é pouco delimitada, afetando a relação dos pais com
os filhos e dificultando na manutenção do poder familiar após a ruptura do casal. O
papel do Judiciário, como deve ser, é de preservação do menor ante a sua prioridade
absoluta.
The present study’s purpose is to analyze and discuss parenting after divorce and how the separation can impact on the relationship of parents with their children and on the construction of their healthy development, as well as the role of the Judiciary in preventing and resolving these situations, in compliance with the principles, duties and rights provided in the Federal Constitution, the Child and Adolescent Statute and the Civil Code. In chronological order of events, was sought to study the development of the marital relationship, the formation of family power, the separation of the couple with a minor child and the interference of feelings and the historical-social parental model in family relationships, which can cause the arrival of the family in court to resolve conflicts and the role of the Judiciary in matters involving Family Law focusing on children and adolescents. Finally, was sought to understand and study, above all, the intrinsic duties to family power that do not unfold with the separation of the couple. The methodology used to prepare this study was a multidisciplinary and doctrinal bibliographic review, focusing on Psychology and Law, and jurisprudence research to verify the current understanding of the courts on the subject. It was found that the boundary between conjugality and parenting is not well defined, affecting the relationship of parents with their children and making it difficult to maintain family power after the couple's separation. The role of the Judiciary, as it should be, is to preserve the minor in view of his absolute priority.
