Há muito tempo, a comunidade LGBTQ é alvo de preconceito e repúdio social, advindos de uma ideia conservadora e retrógrada criada pela igreja, de que a família só pode ser formada para fins de procriação. Isso acabou por suprimir o direito dessas pessoas a uma vida feliz junto a pessoas que amam. As relações homoafetivas foram excluídas da mesma proteção jurídica que é garantida a quem possui vínculo afetivo com uma pessoa do sexo oposto. Porém, após muita luta contra a omissão legal praticada pelos legisladores, com o crescimento dos direitos humanos e a laicização do Estado, muitos direitos vêm sendo conquistados ao longo dos anos. O objetivo desse trabalho é mostrar a evolução desses direitos e fazer uma compilação dos aspectos jurídicos mais importantes para garantir a proteção de famílias homoafetivas.
For a long time, LGBTQ community is target of prejudice and social rejection, because of a conservative and retrograde idea created by the church, that family can only be formed for procriation goals. That ended up suppressing the right of these people to have a happy life together with the ones they love. The homoaffective relationships were excluded of the same judiciary protection given for those who have an affective relationship with people of the opposite sex. However, after a lot of fight against legal omission practiced by legislastors, the growing of human rights and the withdrawal of the religious character of the State, a lot of rights have been acquired over the years. The goal of this work is to demonstrate the evolution of this rights and make a compilation with the most important legal aspects to guarantee the protection of homoaffective families.
